HRCC petitions Malawi judiciary system on transparency and accountability

LILONGWE-(MaraviPost)-Human Rights Consultative Committee (HRCC) has urged Malawi judiciary to ensure accountability and transparency in execution of the ongoing court cases following the tripartite elections.

According to the written communication to the chief Justice, HRCC has expressed concern over various verbal and written complaints that they have received from Malawians over court proceedings on various other cases.

Delays in passing of dates for case hearings due to uncontrolled backlog of undealt with cases, missing of files before case hearing, inordinately long period before a written judgment is served after the conclusion of the cases among others are some of the complaints that the body has received.

The body recognizes that access to justice is a fundamental human right which is a vital ingredient in the protection and enforcement
of other human rights and therefore the need for judicial system to ensure it observes this. HRCC has also uncover that recently the cost of legal services have become prohibitive thereby limiting those who are unable to access justices.

In the letter written to the judiciary system, HRCC body has also asked the judiciary system to zero in on how members of the judiciary are held accountable for their
decision which in itself are not in the interest of delivering of justice.
