Is there a need for willy-nilly Malawi court injunctions?

Injunctions have become very common in Malawi and politicians have taken injunctions, perhaps more than anyone else. The article takes a short look at this legal practice so that we understand what it is all about.

Purpose

First, The usual purpose of an injunction is to preserve the status quo in situations in which further acts of the specified type, or the failure to perform such acts, would cause one of the parties irreparable harm (i.e., harm that cannot be adequately remedied by an award of monetary damages).

Let’s go into the definition of court injunction. It is an extraordinary remedy that courts utilize in special cases to alter or maintain the status quo, depending on the circumstances, particularly where the defendant must stop its course of action to prevent possible injustice and irreparable harm to the plaintiff.

An injunction is a court order sometimes called a “Restraining Order” that directs a person not to have any contact with you. It is one legal means of helping to protect a person from threats or acts of violence by another person.

Disadvantages

Aside from specific performance, where a court forces a party to fulfill a contractual obligation, it is more difficult to use an injunction to force another party to do something. Also, parties may have only a limited amount of time to petition the court for an injunction.

Plaintiffs make this motion for a preliminary injunction on the grounds that (1) Plaintiffs have demonstrated a likelihood of succeeding on the merits of their claim that Defendant has [describe unlawful conduct]; (2) Plaintiffs are likely to suffer irreparable harm in the absence of the relief requested.

Advantages

One of the benefits of an injunction as a remedy, as opposed to a claim for damages or an account of profits, is that injunctions can either be interlocutory or final.

An interlocutory or interim injunction is granted at an early stage in the court proceedings, pending a final decision by the court at trial.

Finally, An injunction is a court order delivered in a civil trial or suit.

This court order stops the defendant from pursuing a certain activity.

This can include constructing a new building, pursuing a business venture, or making transactions that are harmful to the plaintiff.
