Malawi Cashgate trials resume, should Kasambara be allowed to be lawyer and defendant?

When we were rudely interrupted in August of last year famed attorney Raphael Kasambara was taking it to Paul Mphwiyo in court. Paul Mphwiyo as a witness was being torn apart.

A lot has happened since we saw Mr. Mphwiyo in court being grilled mercilessly by one Raphael Kasambara. Paul Mphwiyo has been arrested multiple times including his wife. Many suspect pressure is being put to bear so that he can rat on bigger fish.

Mr. Lutepo has also been squealing like a pig. Naming names and claiming he was just a small pawn in the whole saga. From afar President Joyce Banda has defended herself forcefully through surrogates.

Last time he was in court, Paul Mphwiyo stated that he was not able to recognize the actual shooter but at his house he told the court that he recognized the one who pulled the trigger.

The cross-examination also revealed glaring inconsistencies between what he stated in examination in-chief and during cross-examination.

The Maravi Post warned you to expect more drama to unfold. We anticipated that Raphael Kasambara known for his theatrics in court had more up his sleeve.

It was also revealed in court that the Vehicle that Paul Mphwiyo was driving that night cannot be found. Paul Mphwiyo told the court that even though he knew it was part of evidence he sold it.

A New York mob lawyer who the prosecution could not defeat was kicked from the case. His name was Cutler.

Cutler gained notoriety in the 1980s when he won three acquittals for Gambino Crime Family boss John Gotti (including one where at least one juror accepted a bribe in return for voting to find Gotti not guilty).

When Gotti was indicted in 1990 for the 1985 murder of Paul Castellano and several other crimes, presiding judge I. Leo Glasser disqualified Cutler and two associates from representing Gotti.

Raphael Kasambara does not appear to be fazed with the whole thing. Should the prosecution consider taking him off from the defense bench? We ask because Raphael is both defendant and also lawyer for his own case and also defense lawyer for others
