Malawi court orders Mutharika, Muhara’s properties seizing over unpaid legal fees

LILONGWE-(MaraviPost)-The High Court on May 4, 2021 ordered that former Malawi President Peter Mutharika and ex-Chief Secretary to government Lloyd Muhara’s properties be seized and sold over remained unpaid legal fees in Chief Justice Charles Nyirenda case.

According to the court document available to The Maravi Post, Mutharika and Muhara have managed to pay MK47.4 million out of MK69.5 million remaining with MK22 million.

The court has ordered sheriff to seize and sale the duo’s properties to meet the remaining legal fees.

“The court is ordering Sheriff of Malawi whereas in the above named action it was on the 12th day of march 2021, adjudged that the respondents, do pay the applicants the sum of MK69 507 461.00 in party and party costs.And whereas aformentioned respondents have only paid MK47 437 125.11 and they remain indebted to the applicants in the sum of MK22 070 335.89.

“You are hereby ordered to seize and sell all of the moveable property of the above name Prof Arthur Peter Mutharika and Lloyd Muhara, except the exempted from seizure under the Sheriff Act, so as to realize the judgement debt in the sum of MK22 070 335.89 and the costs of your execution of this enforcement order,” reads Justice Kenyatta Nyirenda’s order
