Two men, who were arrested on Monday, December 7, in the capital Lilongwe on suspicion that were engaging in homosexual acts in theirhouse at Area 25 township have been charged with sodomy which attracts 14 years in Imprisonment with Hard Labor (IHL) if found guilty.
Kanengo Police Station Spokesperson, Esther Mkwanda on Friday, December 11, confirmed to The Maravi Post the release of the two men out of bail and charged with Sodomy contrary to section 153 (c) of the Penal Code.
The two suspected gays, Cuthbert Kulemera and Kelvin Gonani were arrested on Monday in the capital Lilongwe, following the commotion residents caused due to the two’s alleged act which they feared that their children could fall into the same trap.
“The police have released the two suspected gays on bail and charged them with Sodomy contrary to Section 153 (c) of the Penal Code which attracts 14 years in jail if found guilty. Although, medical reports from Kamuzu Central Hospital (KCH) are in our possession, investigations are still under way. But we won’t disclose the results
to the public as they will be used as evidence in the court of law once all investigations are done”, disclosed the Police Publicist Mkwanda.
In an earlier exclusive interview with The Maravi Post the Kanengo Police Station Spokesperson Mkwanda disclosed that Kulemera who is a student was suspected to have had sex with Gonani which did not please communities around the area fearing that their children might fall victims to Gonani.
“On this day, Kulemera left home for drinking spree at Nsungwi Market in Area 25 township where he met Gonani who to took the student to his house which puzzled neighbors on their acts leading commotion at the house.
The police were alerted on the commotion. After interrogation, Kulermera confessed that he acted as a man while Gonani acted as a woman in their sexual activity”, elaborated Mkwanda.
Gonani hails from Kafupa village, Traditional Authority (T.A) Kapeniin Blantyre district.
Homosexuality is a criminal offence under the laws of Malawi and those found guilty of practicing it are reliable to stay in jail for 14 years with hard labour.
Some years ago, Malawi witnessed the first homosexual couple holding public engagement ceremony-that of Tiwonge Chimbalanga and Steve Muwonjeza who received a lot of condemnations from the general public of their acts subsequently, the court slapped them with 14 years in jail.
However, their sentence was overturned by the late President Bingu wa Mutharika who forgave them after being pressurized by the visiting United Nations (UN) Secretary General Ban Ki Moon when the saga surfaced.
