Malawi Presidential Elections Case: MCP lead lawyer Msisha insists on Chakwera as polls winner

LILONGWE-(MaraviPost)-The opposition Malawi Congress Party (MCP) lead lawyer Senior Counsel Mordecai Msisha in the ongoing Presidential election case on Friday told the constitutional court that Dr. Lazarus Chakwera was the legitimate winner for May 21, 2019 polls.

Msisha was making his final oral submission for MCP President Chakwera, who is the 2nd Petitioner in the presidential election case at the Constitutional Court.

In his closing remarks, he articulated the remedies he seeks the court to make to rectify the massive irregularities committed by Malawi Electoral Commission (MEC).

Msisha reminded the ConCort has jurisdiction to administer what Section 41 of the Constitution describes as “an effective remedy” to address MEC’s violations of the political rights of Malawian voters whose will was defeated by either incompetence or fraud, or both.

According to Msisha, though it is for the Court to decide what an effective remedy is, the Court should not only declare the election of President Peter Mutharika as null and void

“but the court must also consider declaring Dr. Chakwera the rightful winner of the 2019 elections if the Court is persuaded by evidence to that effect”, says Msisha.

The court is expected to wind up final oral submissions from all parties in the case today, Friday, 2019.
