MANA-(MANGOCHI)-Mangochi Senior Resident Magistrate Court on Friday convicted and sentenced Ishmael Saidi, 18, to six years imprisonment with hard labour upon being found guilty on four counts of theft.
State Prosecutor Sub Inspector Ezekiel Kalunga said the accused was charged with the offence of theft of a motorcycle, contrary to Section 282 (1), theft of bicycle contrary to Section 282 (b) and other two offences of theft contrary to Section 278 of the Penal Code.
The court learnt that Saidi stole a motorcycle worth K550, 000 at Chikundo Village in Mangochi on November 19, this year.
“The accused had also stolen one bicycle, three cell phones and one motorcycle on different occasions at Mtanga Village in Traditional Authority Chimwala in Mangochi,” Kalunga explained.
“He was apprehended by one complainant from whom the accused had stolen a cell phone, a Huawei P9, within Mtanga area,” Kalunga added.
Saidi pleaded guilty and admitted to the first charge of theft of motorcycle contrary to Section 282 (1) and denied the other charges.
This prompted the state to parade four witnesses who proved the case beyond reasonable doubt.
In submission, the state said Saidi was a first offender but asked the court to consider the gravity of the offences.
“Stealing a motorcycle and bicycle calls for 10 years imprisonment as no items were recovered,” Kalunga said, insisting that the court should give Saidi a stiffer penalty to deter other would-be offenders from committing similar offences.
In mitigation, Saidi asked for forgiveness and assured the court that he would never commit any such offence again.
He also asked for leniency on account that he is a student and lives with his grandmother and two young brothers who depend on him.
However, passing sentence, Senior Resident Magistrate Rodrick Michongwe concurred with the state’s plea for stiffer penalty, saying the accused had a well calculated move as he came from Machinga to commit a crime in Mangochi.
“We are trying to make peace in this district but people like you are coming in to pose threats and your age does not fit what you are doing,” Michongwe said, adding that Saidi deserved a custodial sentence.
He, therefore, sentenced Saidi to six years imprisonment with hard labour for the first and second counts, two years for the third and fourth counts.
Michongwe said the sentences would run concurrently starting from the day of arrest.
Saidi’s real home is Mteragosi Village, Niassa District in Mozambique but stays in Machinga.

NAIROBI-(MaraviPost)-The Police in Nairobi have arrested Sebastian Kamande, 28, for allegedly poisoned his wife and her female friend on March 29, 2022 before going into hiding.
The Directorate of Criminal Investigations arrested the suspect along the Embu-Nairobi highway as he attempted to flee from the DCI detectives.

“The suspect was nabbed on Friday at Sagana River while on his way back to Nairobi, in a bid to outfox the DCI team.

The Standard report indicated that Kamande served the poisoned food to his wife Rahab Gathoni and her friend Abigael Gathoni, who had come visiting, before fleeing their Dandora home leaving their lifeless bodies sprawled on the floor.
This reportedly happened after the estranged couple returned from the man’s parents’ home in Kakuzi, Murang’a County, where they had been invited in an attempt to rekindle their union which is said to have been on its death bed.

LILONGWE-(MaraviPost)-The Civil society that fight for people’s economic independence, the Citizens Advancement for Economic Revolution (CARE) has described the Electricity Supply Corporation of Malawi (ESCOM) plans to claim payments of the electricity token from customers in the MK60 billion electricity token reselling syndicate involving the corporation and Electricity Generation Company Malawi Limited (EGENCO) employees as economic sabotage.

Recently ESCOM complained that it is losing billions of kwachas through the reselling of electricity tokens.
Speaking on the matter CARE Executive Director Fredrick Billy Malata said that the blame game between ESCOM and EGENCO will not bear tangible results, saying that the issue need disciplinary actions of the employees from both institutions.
Malata added that ESCOM decision to reclaim the electricity units from the customers is uncalled for, as this is an internal issue that calls for disciplinary actions of the concerned individuals rather than pushing the blame to other people.
“We understand that ESCOM is planning to claim electricity units that were sold to the customers. This is an internal issue that need to be addressed administratively rather than pushing the blame to the innocent customers”, he explained.
Malata has since urged ESCOM to reverse it’s plans to claim electricity tokens from customers adding that the grouping will seek legal action on the matter should the state electricity supplier continue with it’s decision.
“ESCOM Should not continue with it’s decision to claim payments of Electricity units from customers,if the decision will not be reversed,CARE will no have choice but to seek legal redress on the matter”, he said.
Individuals and companies alleged to have been benefited from the electricity reselling scandal among include Kips and Galitos restaurants as well as Mangochi South West parliamentarian Shadrick Namalomba.
