Timothy Busfield’s Child Sex Abuse Case Explained: What to Know

Actor and director Timothy Busfield is facing charges of sexual abuse involving a minor after he was accused of misconduct with a child actor on the set of The Cleaning Lady.

Busfield — who executive-produced 14 episodes of the Fox series and directed six, as well as a one-episode appearance as an immigration officer — was accused of touching the child actor inappropriately in incidents that allegedly occurred between late 2022 and early 2024, according to the Albuquerque Police Department affidavit obtained by Us Weekly in January 2026.

In an interview with police during the investigation, Busfield denied that there was anything “weird” about his interactions with the children on set, according to the criminal complaint. He is facing two counts of criminal sexual contact of a minor and one count of child abuse.

“He didn’t do anything wrong,” Busfield’s attorney Larry Stein claimed in a statement to NBC News on January 13, 2026, after Busfield surrendered to the police. “These accusations are false as the investigator from the independent law firm found.”

A warrant for Busfield’s arrest, obtained by Us, was issued by authorities in New Mexico on January 9, 2026, after he was accused of sexual misconduct involving a minor.

The alleged incidents occurred while Busfield was directing The Cleaning Lady, which aired on Fox from 2022 to 2025. Busfield’s accuser and his twin brother worked as child actors on the show.

According to the criminal complaint, the child involved claimed that Busfield first touched his “private areas” inappropriately when he was 7 years old. He accused the West Wing alum of touching him three or four times.

In a separate incident when the child was 8 years old, Busfield allegedly touched him five or six times.

The boy was “very afraid of Tim and was relieved when he was off set,” according to the affidavit. He also stated that he “was afraid to tell anyone because Tim was the director, and he feared Tim would get mad at him.”

The child’s mother reported to Child Protective Services that the alleged abuse occurred between late 2022 and the second half of 2024, according to the complaint. The child was diagnosed with post-traumatic stress disorder and anxiety following the alleged incidents.

Timothy Busfield Was Interviewed About the Sexual Abuse Allegations

According to the affidavit, Timothy Busfield was interviewed by Officer Marvin Brown via phone regarding the alleged incidents in November 2025. He was asked if he had any “physical contact” with the children, such as picking them up or tickling them.

“Timothy said it was highly likely that he would have,” the affidavit stated, adding that Busfield described the set as a “playful environment.” Busfield added that there was “never a weird moment about it” and that any contact was “in front of the parents,” according to the complaint.

Busfield also stated that there was “no protocol” for touching children on set.

“I mean, I’m always around people, right? It would be, you know, in front of the parents. There would never be a weird moment about it,” he said. “I don’t really remember picking those boys up. I remember picking up the boy who followed them. I’d pick him up and he’d be giggling and that would sort of get him ready to act.”

Busfield claimed the children were “never alone on set without the teacher, a welfare worker, or a parent.”

According to the complaint, Timothy Busfield also admitted that he and wife Melissa Gilbert “did buy the two boys Christmas gifts and were together [at] several social functions.”

Brown concluded that Busfield allegedly chose to “invite the family to off-set gatherings, with his wife buying Christmas gifts to foster closeness.” He further theorized that this was an example of “classic grooming to erode boundaries, isolate the victim, and silence suspicions by blending abuse into normalcy.”

Days before the arrest warrant was issued, Melissa Gilbert took to Instagram to share a quote that read, “You seem to have a mistaken discomfort for injustice.”

In a comment, she stated that she was referring to those “playing the victim and blaming others.”

“It’s about not taking accountability for your own situation,” Gilbert added. “It’s about being a big whiny baby. I saw this quote and it struck me. I have a particularly hard time with people who play the victim. Own your s***. Step up. It’s all pretty general. Has nothing to do with politics but everything to do with privilege, attitude and weakness.”

In November 2025, Gilbert also reflected on having to kiss a 23-year-old costar when she was just 15 on Little House on the Prairie.

“Through the lens of today, this is shocking. I have no words other than to say , ‘I WAS A CHILD. I WAS FIFTEEN,’” she wrote via Instagram. “Thank God my mom and Michael [Landon] and so many others were there to make sure I was safe. Can you imagine if I hadn’t had them all? I am so fortunate (Sort of). Many other young women aren’t.”

Gilbert has since deleted her social media accounts.

Timothy Busfield Surrenders to Police and Breaks Silence on Arrest

Timothy Busfield surrendered himself to law enforcement in New Mexico days after his arrest warrant was issued, TMZ reported on January 13, 2026. Before turning himself in, Busfield made a statement at his attorney’s office, as seen in a video obtained by the outlet.

“Hi everybody, it’s Tim. I’m sure most of you know that I was ordered to come to Albuquerque. I’m here now. I got the call Friday night, I had to get a lawyer. Saturday, I got in the car and drove 2,000 miles to Albuquerque,” he said.

Busfield declared that he is going to “confront these lies,” calling them “horrible.”

“I did not do anything to those little boys,” he continued. “And I’m gonna fight it. I’m gonna fight it with a great team, and I’m gonna be exonerated. I know I am, ‘cause this is all so wrong and so lies.”

Busfield concluded, “So hang in there, and hopefully I’m out real soon.”

Busfield’s lawyer, Larry Stein, told TMZ that he believes there was a “revenge factor” to the criminal complaint. He claimed that the mother of the boys told one of the actresses on The Cleaning Lady set that she “vowed to get revenge after her sons were cut from the final season of the show.”

After Us confirmed that Timothy Busfield had surrendered to authorities in New Mexico, Melissa Gilbert’s publicist released a statement saying the Little House on the Prairie actress stands by her husband.

“During this period, her focus is on supporting and caring for their very large family, as they navigate this moment,” the statement read. “Melissa stands with and supports her husband and will address the public at an appropriate time. We ask that their privacy be respected.”

Gilbert’s rep added that the actress will not be making statements at the request of Busfield’s lawyers.

Her lifestyle company, Modern Prairie, did, however, release a statement via its company Instagram hours after Busfield surrendered to authorities.

“Modern Prairie is aware of recent media reports regarding serious allegations involving a family member of our brand muse, Melissa Gilbert. These allegations do not involve Modern Prairie, our operations, nor our community,” the statement read. “Modern Prairie unequivocally condemns abuse in all forms and remains committed to values of safety, integrity and respect. While these matters are personal and do not directly involve Melissa or the brand, we are respecting the privacy of the family as they navigate a difficult and personal situation.”

Following Busfield’s arrest, Gilbert also asked the judge presiding over the case to keep her husband out of harm’s way while he was in jail in an emotional character letter.

“I only want this extraordinary man safe and whole,” she penned, according to court documents obtained by Us Weekly on January 16. “Please, please, take care of my sweet husband. As he is my protector, I am his, but I cannot protect him now and I think that, more than anything else, is what is truly breaking my heart, I am relying on [you] to protect him for me.”

Timothy Busfield’s Mugshot Is Released

Us obtained Timothy Busfield’s mugshot hours after he surrendered to the police on January 13, 2026.

In the photo, Busfield wore a light-washed green T-shirt and had white facial hair, including a beard. Busfield was booked in New Mexico after three warrants were issued for his arrest, including two for “criminal sexual contract/minor 3rd degree” for a child under 13 and one for “child abuse” listed as “intentional” and “1st offense,” according to documents obtained by Us.

The booking paperwork also listed Busfield as an “active” hold but his bail amount had not been set.

Timothy Busfield Faces New Sexual Abuse Accusations

A pretrial detention motion filed on January 14, 2026, revealed that “another victim’s father,” Colin Swift, reported to law enforcement the day prior that Timothy Busfield allegedly sexually abused Swift’s daughter “several years ago” in Sacramento, California.

“While auditioning for [Busfield] at B Street Theatre, the 16-year-old reported that [Busfield] kissed her and put his hands down her pants and touched her privates,” the motion states, according to People.

Busfield allegedly “begged the family to not report to law enforcement if he received therapy.” Swift, who is a “therapist himself,” thought this was “the best thing to do” at the time.

Busfield’s attorney responded to the new allegations in a statement to People.

“The allegations were never challenged, they were never proved, and they’re 25 years old,” Stein said. “And there doesn’t seem to be any connection between these allegations regarding women 25 years ago and the allegations regarding these young boys.”

Prosecutors have requested that Busfield remain detained until his trial.

“The Defendant’s repeated sexual touching of the victim’s intimate areas, combined with deliberate grooming behaviors, establishes a sustained pattern of predatory conduct,” the motion stated. “This conduct demonstrates that the Defendant poses a serious and ongoing danger not only to the named victims, but to any child placed within his proximity. Sexual exploitation of children reflects a profound disregard for the physical safety, emotional well-being and developmental health of minors, and it evidences a risk that cannot be adequately mitigated through supervision or conditional release.”

Timothy Busfield Dropped From Talent Agency

Timothy Busfield was dropped from his talent agency, Innovative Artists, amid his child sex abuse case, a rep for the company confirmed to Deadline. Busfield had been with the agency for several years, working with a “fair-sized” team, according to the outlet.

Lawyer Shares Insight Into Timothy Busfield’s Case

Dave Ring, partner at Taylor & Ring in Los Angeles, exclusively told Us Weekly that one factor could make or break Timothy Busfield’s case.

“The most decisive factor will be whether these boys were pressured or influenced by an adult to make allegedly false accusations against Busfield,” Ring, who specializes in child sexual assault cases but is not involved in Busfield’s case, said.

He continued, “The boys originally said the touching only consisted of tickling. Later, they said it included touching of the genitals. That is what turned the case and resulted in Busfield’s arrest. It will be crucial to determine if any outside influence caused the boys to change their story. It is not at all unusual for children to disclose abuse over time, rather than the very first time they are confronted about it.”

A New Witness Comes Forward

In an affidavit obtained by Us Weekly in January 2026, a witness provided new details about the allegations made by a teenage girl against Timothy Busfield. Matthew Moore claimed that he and the teen apprenticed at the B Street Theatre in 2000, where Busfield worked as director.

According to Moore, Busfield received a shoulder massage from the girl while directing him during a class at the theatre. Moore shared that he “did not see” Busfield “initiate physical contact” with the girl, noting that nothing appeared “to be predatory or abusive.”

Moore also claimed that the girl’s father, Colin Swift, made “uncomfortable” comments about his daughter’s relationship with Busfield. He alleged that Swift told him he had written a TV show pilot that Busfield was going to help make happen.

“I don’t need an agent because you guys are going to be stars,” Moore recalled Swift allegedly saying, per the docs. “They are going to love it because Tim Busfield is going to present it to them, which I’m certain he will do because he will need to if he thinks he’s going to f*** my daughter.”

Timothy Busfield Released From Jail

On January 16, Busfield’s legal team filed a motion to fight his pretrial incarceration, arguing there wasn’t enough evidence against him to justify keeping him in jail.

“The state offers no reliable proof — only allegations advanced by witnesses with documented histories of fraud and financial exploitation, contradicted by a comprehensive studio investigation, and refuted by witnesses and objective risk assessments,” the court docs obtained by Us read. “The Constitution does not allow liberty to be forfeited on such a foundation. The state’s motion should be denied.”

Busfield was released from jail on January 20. Since then, he and Gilbert have been “very involved” working with his lawyer to build his defense, according to a source who spoke with People.

Gilbert is expected to attend “all” of Busfield’s future court hearings in support of her husband.

Timothy Busfield Indicted in Child Sex Abuse Case

A grand jury in New Mexico indicted Timothy Busfield on four counts of criminal sexual contact of a child in February 2026, according to a press release from the Bernalillo County District Attorney’s office.

“As with all criminal proceedings, Mr. Busfield is presumed innocent unless and until proven guilty in a court of law,” Bernalillo County District Attorney Sam Bregman said in a statement. “This case will proceed through the judicial process and is expected to move forward to trial.”

Bregman said the case will be prosecuted by his office’s special victims unit.

‘Neighbors With Benefits’ Alum Has Pets Seized After Sex Crimes Arrest

Local Ohio police have seized Neighbors With Benefits alum Tony McCollister’s pets in light of his recent arrest for child and animal sex crimes.

Warren County sheriff Barry Riley told TMZ on Saturday, December 27, that McCollister’s pets were confiscated during a police investigation and “are being well cared for.”

McCollister, 43, was arraigned on Thursday, December 25, according to Cincinnati’s WLWT outlet, where he was charged with pandering obscene content involving a minor and sexual conduct with an animal.

According to court documents obtained by the outlet, McCollister allegedly uploaded child sexual abuse material to a Google account and engaged in sexual activities with two dogs.

‘Neighbors With Benefits’ Alum Arrested for Child and Animal Sex Crimes

McCollister was granted $250,000 bail on Thursday and ordered to have no contact with any children or pets. His next court hearing is scheduled for Tuesday, December 30.

Tony and his then-wife, Diana McCollister, previously starred on A&E’s Neighbors With Benefits. The docuseries followed their lifestyle as swingers and was canceled in 2015 after two episodes due to viewer backlash.

“We did it for a reason. We want our story told,” Diana, who shares three children with Tony, told Cincinnati’s Fox affiliate in May 2015 of joining the reality TV show. “This is how we swing. We just want to show our side of things because we do feel like we’re happy. We have a great life. We wanted to show the other side. That we are still normal people and put all of those negative images people think of when they think of swinging to rest.”

She continued at the time, “There’s definitely ups and downs with it. Definitely harder times. Arguments and disagreements. It keeps your marriage exciting. There are no boundaries. We don’t know what we are going to do tomorrow or the next day or the day after.”

While speaking with the local newspaper, Tony reiterated how they were “happy with” their marriage after adopting a swinging lifestyle.

“Us defining marriage our way does not hurt your marriage. It does not belittle your marriage. It doesn’t do anything to your marriage,” he explained at the time. “Be happy with your marriage. We’re happy with ours. The lifestyle isn’t for everyone.”

Tony added, “You’re not going to force your spouse into it and have it end well. There are a lot of negative things that go along with this but it can be a very positive thing if you approach it in an open honest way with open honest communication.”

Elementary Teacher Who Sent Teen 35K Texts in 3 Months Cries in Court

A recently engaged Wisconsin woman will spend the next six years in prison after allegedly admitting to kissing an 11-year-old boy in her classroom — and later sending him 35,000 explicit text messages.

Madison Bergmann, 26, was working as a fifth grade teacher at River Crest Elementary School in Hudson, Wisconsin, until the victim’s father discovered the deluge of texts.

The boy’s dad told the court during Bergmann’s sentencing on Friday, December 19, that he found the messages “disturbing.”

The messages were sent over just three months, meaning she sent an average of over 2,000 messages to the victim every day. In the texts, Bergmann allegedly professed her affections for the boy and expressed her eagerness at touching him and “making out” with him again.

Her former coworker at the school, Abigail Faust, is also facing charges for inappropriate relationships with children, including a child whom she nannied in Washington County.

Bergmann pleaded guilty to one count of child enticement and two counts of sexual misconduct by school staff back in September.

After the father brought the text messages to the police, officers searched her classroom and found a folder with the victim’s name on it containing handwritten love letters that indicated they had kissed.

Bergmann was supposed to get married in 2024. It is unclear when she got engaged.

Former Teacher Accused of Having Unlawful Sexual Relations with Student

She started to cry as soon as she entered the courtroom for her sentencing. The state had been seeking a 12-year sentence for the disgraced teacher.

Bergmann’s lawyers had been pushing for a one-year sentence.

“I want to make it absolutely clear that I take full accountability for every boundary that was crossed,” she said through tears. “I hope that your family has been able to begin to heal and find some peace in your lives again. I know the journey will be long for your family.”

She cried louder when she learned her sentence, according to KSTP.

“To his own credit, [my son] is like ‘I have to live with this forever. Whatever punishment she receives should be forever,’” the victim’s father said, according to KARE11. “When I review the texts too, it’s very deliberate — talking about touching his leg, talking to my 11-year-old son about her period, talking about his erections … to me it’s very disturbing stuff.”

Bergmann pleaded guilty as part of a plea deal from prosecutors that saw a number of charges against her dropped, including first-degree sexual assault of a child, using a computer to facilitate a child sex crime, exposing a child to harmful descriptions, and additional counts of sexual misconduct by school staff and child enticement.

When she is released from prison in six years, Bergmann will need to register as a convicted sex offender. She will also be placed on six years of extended supervision and is barred from having contact with minors without approval. The court has also placed restrictions on her internet use, according to KARE11.

Marciano Brunette Sues Demi Engemann After She Accused Him of Sexual Assault

Marciano Brunette is suing The Secret Lives of Mormon Wives star Demi Engemann after she accused him of sexual assault.

In legal documents obtained by Us Weekly on Friday, December 5, Vanderpump Villa star, 32, and his legal team claimed Demi, 31, falsely described him as a “sexual predator” – allegations which he claimed has damaged his reputation.

Marciano’s legal team alleged via the docs that Demi’s comments that she received “unwanted touch” from him while filming for Vanderpump Villa in Italy in August 2024 were untrue. He insisted any physical interaction between them was consensual.

“The truth is straightforward. Engemann and Marciano met while filming in Italy. They flirted. They spoke privately. They shared a consensual kiss. They separated,” the documents read. “After filming, Engemann stayed in contact with Marciano for months through calls, FaceTime, texts, invitations, and even location sharing. That behavior confirms a continued relationship, not a person reacting to sexual assault.”

Describing the sexual misconduct accusations against the reality star as “false,” Marciano’s legal team further alleged Demi’s claims have caused “severe” damage to Marciano’s reputation.

“They accuse Marciano of criminal sexual conduct he did not commit. They were published broadly, republished repeatedly, and framed to harden into ‘truth’ in the minds of viewers,” the documents continued. “The damage has been immediate and severe, including lost professional opportunities, harassment by strangers, and lasting harm to Marciano’s reputation.”

The lawsuit also accused production of having “amplified the same accusations for profit.”

During a confessional in The Secret Lives of Mormon Wives’ third season, Demi, who is married to Bret Engemann, insisted that any physicality between her and Marciano was “unwanted.” Marciano previously alleged that they kissed.

“Everyone is going to handle these kinds of situations different. You never deserve unwanted touch,” the influencer said at the time. “No matter what it looks like, no matter what your relationship was like before or after, unwanted touch is unwanted touch.”

Following the episode, Maricano has remained adamant that the claims against him are untrue.

“It is unfortunate to see everything that is going on now, because everything that happened [on Vanderpump Villa] was consensual,” Maricano claimed on an episode of the “Juicy Scoop” podcast on November 25. “I will just flat-out say that the accusations she’s making against me are 100 percent false.”

Several days prior to the podcast appearance, he echoed a similar sentiment, calling the claims “entirely false” via a statement to People on November 20.

“I want to be absolutely clear: I am taking this matter extremely seriously,” Marciano said via the statement. “This is the most difficult situation I have ever faced, and the allegations against me are not only entirely false but profoundly damaging. I remain committed to addressing this issue fully and transparently.”

In response, a rep for Demi, 30, told E! News on November 21, “As a woman, it distresses me that what happened to Demi is being minimized.”

Speaking exclusively to Us Weekly in May, Demi denied she was unfaithful to her husband with Marciano in Italy.

“Nothing happened with Marciano. At the expense of sounding rude, there wasn’t even a remote attraction to him. It sucks that women can’t be kind and friendly and even playful with men in this world without it being taken as like you’re open. I had a rock on my finger the entire time I was there,” she exclusively told Us Weekly in May. “I brought up my marriage multiple times and they were told that we were married women — so it sucks that we couldn’t just go and have a good time and that he couldn’t respect that.”

The Daily Mail published a report on November 1, claiming the actress “filed a harassment and bullying claim before they started shooting the last season” of the Netflix hit. A source told the outlet that “there were pages and pages of accusations,” leading to an investigation that “went on for months.”

Brown’s filing reportedly did not include any accusations of sexual misconduct. While filming season 5, Brown allegedly had a representative with her on set.

Since the report was published, the Stranger Things costars have put on a united front in the wake of the accusations.

Just days after the news surfaced, Brown and Harbour arrived together at the world premiere of Stranger Things season 5 in Los Angeles on November 6.

In a video shared via both Netflix and Stranger Things’ official Instagram accounts, the actors were seen hugging and joking around in a playful display as they interacted with Stranger Things fans on the carpet.

Several weeks later, Brown spoke about her relationship dynamic with Harbour.

“We love this show with everything, and we value our friendship more than anything,” Brown told The Hollywood Reporter in an interview published on November 26.

Definitely 2017 will go down in history as the year multiple women made multiple allegations of misconduct by multiple men, with multiple reactions, among them these men losing their decades-long careers. The men in high-profiled positions in the media, entertainment and political platforms, that threatens to remap the optics in corporate America. After decades of facing sexual harassment, rape and misconduct by men in the workplace, women are speaking out. Employers are caused to draw the line in defense of the women.

In July 2016, Fox News co-founder and CEO Roger Ailes was forced to step down as the CEO of the network after former anchor Gretchen Carlson filed a sexual harassment lawsuit against him. Soon after, six other female employees followed with details of similar claims including by another anchor Megyn Kelly who detailed alleged assaults by Ailes.’ Fox fired its founder and CEO; he died 10 months later in May 2017.
