Nyekhwe! Malawi court dismisses Mutharika, Muhara’s application on MK69.5m stay order payment

Former president Mutharika and Muhara

Mutharika falls again

LILONGWE-(MaraviPost)-The Malawi High Court in the capital Lilongwe on Thursday, April 15, 2021 dismissed an application by former president Peter Mutharika and former secretary to the President and Cabinet Lloyd Muhara to stay execution of order for costs pending review of assessments of costs.

This comes after the court two months ago ordered Mutharika and Muhara to pay MK69.5 million as legal costs after they were faulted for trying to force Chief Justice Andrew Nyirenda and Justice Edward Twea to go on leave pending retirement.

Lawyers for Malawi Law Society, Human Rights Defenders Coalition and Association of Magistrates in Malawi asked the court to order the two to personally meet costs of the case.

However, the two made an application for stay of execution of the order for costs.

The court has since dismissed the application.

This means Mutharika and Muhara are forced to pay the costs as demanded by the court.
