Blantyre man jailed 18 years for defiling and impregnating a 13-year old girl

BLANTYRE-(MaraviPost)-The Senior Resident Magistrate Court in Blantyre on Friday, sentenced Marko Nota to 18 years in jail for defiling and impregnating a 13-year-old girl.

According to Court records, on January 28, 2017, the convict went to the victim’s parents’ shop, where he asked her to be his lover.

After a few minutes following his advances, the girl left the shop for her parent’s house, and that prompted Nota to follow the victim.

On her way home, the convict dragged the girl to a nearby bush, where he gagged her mouth with his hands and started defiling her.

The Court records add that Nota gave the standard 6 primary school pupil MK1,000 and further threatened to kill her if she revealed the ordeal her parents.

It was discovered later that the defilement led to pregnancy. This prompted the police to arrest him and charge him on defilement.

Eventually, Senior Resident Magistrate Peter Kapindu, sentenced Nota to 18 years in jail with hard labor, which is one of the highest prison term meted out so far on defilement convict.

However, defilement carries the maximums sentence of life imprisonment under Malawi laws, which are unlikely that will be passed on to convicts.

Branzil Mchimika: took a 12-year old to be his third wife

Twenty-two-year old Branzil Mchimika, who is a renown notorious young polygamist in Nkhota-kota, on Friday was sentenced to serve a nine-year jail term by the district First Grade Magistrate court for defiling a 12-year old girl (name withheld).

According to Nkhotakota deputy spokesperson for the police Paul Maliwe, Mchimika, a polygamist with two wives, took the 12-year old girl as a third wife.

Malimwe said the convict planned to take the marriage with the girl into hiding by taking her to Salima district. Police however, arrested him at Benga as he was traveling to Salima; this was after police received a tip from community members who were aware of the development.

Mchimika pleaded not guilty to the charges, but police paraded three witnesses to prove their case, following which, the convict admitted that he committed the offence. In mitigation Mchimika pleaded for leniency saying he had two wives and many children.

The presiding First Grade Magistrate Kingsley Buleya, denied the plea and said defilement is a serious offence in nature, and attracts the maximum sentence of life imprisonment. The Magistrage added that these cases are common in Nkhota-kota and in other parts of the country.

“The perpetrators deserve stiff punishments as one way of reducing the malpractice,” he said.

Magistrate Buleya said the marriage of the two was unlawful because of the age of the girl; he therefore slapped Mchimika with nine year’s prison sentence with hard labour; this would serve as a warning to the society as well as a way reducing child marriages in the country.

Mchimika hails from Nthanje Village in Senior Chief Malengachanzi in Nkhota-kota.

MWANZA-(MaraviPost)-A 32 year-old man has on Tuesday been sentenced to 14 years in jail with hard labor for being found guilty of defiling his friend’s daughter contrary to section 138 of the Penal Code.

Mwanza Police Station spokesperson Edwin Kaunda has identified the convict as who happens to be a friend to the victim’s father.

According to Police Publicist Kaunda, the court heard that Mundenguma committed the offense when she saw the victim, aged 13, on her way back from a market in the district.

Kaunda said the convict called the girl’s name from the direction of Matengo Resthouse to which the victim did not hesitate to respond considering that she knew Wyson as her father’s friend.

The publicist added that Mundenguma grabbed the girl’s hand and sweet-talked her into a room in the resthouse on December 31, 2016 where he defiled her.

“After enjoying the sexual intercourse with the girl, Wyson told her never to report to anyone but the girl informed her mother what her father’s friend had done to her. The mother took the girl to Mwanza police where they were further referred to Mwanza District Hospital and medical examination confirmed defilement,” said Kaunda.

Mundenguma was eventually arrested but pleaded not guilty when charged.

After a full trial which involved parading four witnesses against him, His worship Rawell Maganzi found Mundenguma guilty of the charge of defilement and sentenced him to 14 years in jail with hard labor to deter those that might commit the same offence in future.
