“Don’t buy Cool Drop bottled water, it’s contaminated”-CFTC warns Malawians

BLANTYRE-(MaraviPost)-The Competition and Fair Trading Commission (CFTC) is urging the general public not to buy or consume water from five batches of Cool Drop Bottled Natural Mineral water manufactured by Zamm Investments which contains some visible foreign objects.

In a press statement issued on Tuesday, March 19, 2024 and signed by its Executive Director Lloyds Vincent Nkhoma, “The warning goes to traders and the general public is because it has received communication that batch numbers; BTH277, BTH016, BTH253, BTH018 and BTH291 of Cool Drop Bottled Natural Mineral water manufactured by Zamm Investments do not meet the stipulated Malawi Standards”.

Nkhoma adds, “The communication which the Commission received indicates that sealed bottles of water from the affected batch numbers have visible foreign sediments inside the sealed water bottles which contravenes Malawi Bureau of Standards act and the applicable Malawi mandatory standard MS 560:2004”.

It is reported that MBS found that the delay in changing of filters and membranes by the producer resulted in the contamination of the bottled water resulting in the presence of visible foreign objects in the aforementioned batches.

“This finding is also in violation of Section 43(1)(e) the Competition and Fair Trading Act (CFTA) which provides as follows: A person shall not, in relation to a consumer supply any product which is likely to cause injury to health or physical harm to consumers, when properly used, or which does not comply with a consumer safety standard which has been prescribed under any written law.

“In view of the above, CFTC would like to inform traders not to sell the subject batches of the product, if they have them in stock. CFTC is also advising consumers to take necessary precaution not to purchase or consume the said batches of the product,” reads part of the statement.

CFTC further advises , “Consumers must return any such products to their suppliers, and get a full refund if they already purchased the same and has also encouraged consumers who may have purchased the subject product, and have proof of purchase, to report to the commission through its toll free line, 2489 and WhatsApp line, +265 987738749”.

This is the second time Zamm Investments’ Bottled water has been found with foreign objects.

CFTC finds ZAMM Investments guilty of selling contaminated “Cool Drop Water”

LILONGWE-(MaraviPost)-The Competition and Fair Trading Commission (CFTC) has advised the Office of the Director of Public Prosecutions (DPP) to prosecute ZAMM Investments for supplying Cool Drop Natural Mineral Water.

In a press statement signed by CFTC Executive Director, Lloyd Nkhoma observes that ZAMM Investment has been found guilty of selling products likely to cause injury to health or physical harm to consumers and unconscionable conduct in the trade of goods and services.

The verdict follows complaints from MANAC Conference Centre located at Dowa and an anonymous person.

“When the CFTC staff visited the MANAC Conference Centre located at Dowa, they found that the conference facility was serving its customers with sealed “Cool Drop Natural Mineral Water” in 500ml bottles, whose contents had floating debris, an occurrence which brought concerns as to whether the water was safe for human consumption.

“On 12” January 2023, the CFTC received a complaint from a Complainant (who sought anonymity) alleging that she purchased Cool Drop Natural Mineral Water which contained some white debris floating inside. The water was from the same Batch number, manufacture, and expiry date as that found by Commission staff,” reads the CFTC statement.

The commission adds, “The CFTC received another complaint from MANAC Conference Centre located at Dowa, through their letter dated 8th February 2023, alleging that they purchased 50 cases of Cool Drop Natural Mineral Water which had floating debris,” reads part of the statement released on August 30.

Nkhoma said the investigations involved site visits as well as testing of the water samples of the particular batches by the competent authorities namely the central laboratory at the Ministry of Water and Sanitation and the laboratory at the Malawi Bureau of Standards.

“After deliberations by the Commission on the Secretariat’s findings, the following determinations were made; that the respondent should be prosecuted for violating Sections 43(1)(e) and 43(1)(g) of the CFTA.

“Therefore, the Commission should submit the investigations report to the Office of the Director of Public Prosecutions (DPP) for prosecution,” he added.

“The Commission should refer the matter to the Malawi Bureau of Standards for necessary regulatory actions and also conduct a recall of all the products from the affected batches that may still be on the market.

“That the Commission should issue an advisory note to the National Water Resource Authority and the Ministry of Water and Sanitation to conduct due diligence on water abstraction and proximity between the source of water i.e. well, borehole, and the waste disposal tanks at the production facility for ZAMM Investments,” reads the statement further.

ZAMM Investments is yet to comment on CFTC verdict.
