Malawi is a country governed by Laws under the Republican constitution. Any attempts made to breach any law as stipulated in the constitution of Malawi is tantamount to serious breach and disrespect for the Rule of Law.
In the effort to rape the Constitution, President Lazarus Chakwera is not relenting on the battle to fight two commissioners at the Malawi Electoral Commission (MEC) in the name of Linda Kunje and Jean Namathanga.
Truth be told, Namathanga and Kunje were appointed alongside MEC Chair Justice Chifundo Kachale on 7th June 2020. We all know that MEC is a constitutional body and it must continue functioning within the parameters of its legally established constitutional mandate.
Recently the Chief Legal Advisor to Government (AG) Dr. Chikosa Silungwe made and presented a legal opinion advising government to rescind on the decision to fire these two commissioners. The AG said doing so would be illegal.
To the contrary, President Chakwera and his uncivilized cohorts chose to disobey this order and instead have chosen to use the Public Appointments Committee (PAC) to proceed in firing the commissioners saying they were declared incompetent by the court which also ordered the same incompetent MEC to implement its decision to conduct Fresh Presidential Elections.
To the surprise of many, does PAC even realise that it is the same commissioners which authenticated their victory in the May 2019 Tripartite Elections?
Is even President Chakwera aware of the fact that his Presidency victory was declared by MEC to which these two innocent commissioners were party?
If these are to be fired then the whole commission should go and that another election must be conducted because his Presidency was declared by incompetent electoral body.
Is this not a mind striking and unashamed obsession by the President with his Malawi Congress Party? Is this one of the schemes by MCP in their plans to compromise MEC?
Is it now Gospel truth that MCP would wish to see these brilliant and courageous Commissioners out of MEC so that their green- eyed Chakwera gets in and change the entire MEC management?
Mr. President, let these Commissioners be. They were Constitutionally appointed by the Presidency at that time and they are executing their duty on fresh mandate. Stop infringing them based on political affiliation.
They are Malawians too. Stop torturing them, they are also entitled to economic rights and freedom. Any kind of torture is unlawful, stop this barbaric act Mr President.
We are currently waiting for you Mr. President on the plunder of MK6.2 billion by your messengers under your watch.
Malawians are waiting for truthfully consolidated Expenditure Reports by your so called Cluster Leaders who have become unmerciful thieves amidst tough economic situations Malawians are going through.
Time is now for you to restore the Constitutional Order and Respect for the Rule of Law.
