Nkhata-bay man jailed six years for raping own daughter

NKHATABAY-(MaraviPost)-The Nkhata-bay Magistrate Court, in this week convicted and sentenced a 60-year old Joseph Mphande, to six years imprisonment with hard labour for being found guilty of raping his own 22-year old daughter.

Nkhata-bay Police station spokesperson Ignatius Esau, told the Court that in March this year, the girl asked money from her father to start business.

In his response, the father told his daughter that for her business to prosper, she needed a certain medication.

When she quizzed as to what type of medication was needed, the father told his daughter that they needed to have sexual intercourse; to which the daughter refused.

Esau said that on the nights of April 3, and 28th May 2017, the father forcibly raped his daughter; and this prompted her to report him to the village head, who later took the victim to Usisya Police Unit.

The Police publicist added that the victim was referred to Usisya Health Centre, where rape was confirmed. A few days later, Mphande was arrested and charged with rape, which contrary to section 157 (1) of the Malawi Penal Code.

“In Court, Mphande pleaded not guilty to the charge; however, three witnesses were paraded to prove his guilt and on July 12, 2017, he was found guilty. In mitigation, he brought the Court into laughter when he said he is an orphan.

“Passing sentence, FGM Anthony Banda decried Mphande’s behavior. Banda said that as a father he is supposed to provide protection for his daughter not engage in sexual relations with her. He later slapped Mphande with a six-year jailed term taking into consideration his age.

Both the convict Mphande and the victim hail from Kaulanda village, Traditional Authority (T.A.) M’bwana in Nkhata-bay district.

 

Nkhata Bay man gets 13 years in jail for defilement

NKHATA BAY-(MaraviPost)- The Nkhata Bay First Grade Magistrate Court on Friday, sentenced a twenty five-year old man to 13 years imprisonment with hard labor, for being found guilty of defiling a 14-year old girl.

Nkhata Bay Police station spokesperson Ignatius Esau identified the convict as Jacob Sichali, who committed the crime on the night of March 18, this year.

According to Esau, the Court heard that the convict summoned the girl to his house to collect undisclosed items sent by her father.

While the girl was inside house, Sichali defiled the victim. She reported the ordeal to her parents, who immediately alerted the police.

“After appearing in the Court, the convict pleaded not guilty to the charges, which prompted the State to parade three witnesses against Sichala.

Consequently, the Court slapped him with the 13 years in jail with hard labor,” said Esau.

The convict Sichali hails from Ipenza in the northern district of Chitipa.

Police in Nkhata-bay on Sunday, arrested 25-year old Bright Banda on allegations that he, together with seven colleagues, who are on run), robbed the NBS Bank in the district.

Confirming the development to The Maravi Post, Nkhata-bay police spokesperson Ignatius Esau said the robbery occurred around mid-night of April 15, 2017.

According to him, the area Bank Manager Miss Gloria Chirwa, closed the bank around 6 pm, leaving two security guards on duty.

However, Banda together with his friends jumped into the fence and tied both guards with ropes, and managed to enter the banking hall where they stole a TV and other telecommunications items including a UPS gadget.

“They also tampered with an ATM back door, then the door for the strong room, and three desk-top computers; but no hard cash was stolen,” Esau said.

According to the  police spokesperson, the value of the stolen and damaged items yet to be established.

He however, disclosed that the police managed to recover the damaged Uninterrupted Power System (UPS) and also find the weapons that the robbers used. These included a crowbar, two hammers, two hacksaws with eleven hacksaw blades, six spanners, a torch and an iron cutter.

Banda is expected to appear before the court once investigations are over. He is expected to answer charges of breaking into a building and committing a felony therein, an offence that contravenes section 311(1)of the country’s penal code.

The suspect hails from Chileka village in the area of Traditional Authority ( TA ) Kalolo in Lilongwe district.

Malawian grandpa behind bars for defiling 12-year old girl  

Police in Nkhata bay are keeping in custody Silale Kaunda, 68, on allegation that he defiled a 12 year-old girl at Mpamba trading center in the district.

According to the district police spokesperson Ignatius Esau, the suspect invited the victim into his house where she was defiled.

In an attempt to keep the girl’s mouth shut, the suspect offered the victim K300.

“The issue came to light after the girl’s mother noticed some walking difficulties in her daughter and the victim revealed that she was defiled by the above mentioned suspect after questioned,” said Esau.

The incident was reported to Nkhata bay police and the victim was referred to Mpamba health centre where defilement was confirmed.

He said the suspect will appear before the court soon to answer defilement charges which is against section 138 of the penal code.

Kaunda hails from Tayawaka village in the area of Traditional Authority ( TA ) Timbili in Nkhatabay distirict.

Malawi court in Nkhata Bay convicts MV Illala crew official for defilement

NKHATABAY-(MaraviPost) – The Malawi court in the lakeshore district of Nkhata Bay has convicted a 25 year old MV Illala ship cabin crew member to 14 years imprisonement for being found guilty of defiling a 12-year-old girl.

Nkhata Bay Police Station spokesperson Ignatius Esau has identified the convict as Winiko Pumula who committed the crime on January 2, this year while on duty on the Chirumba-Tchalo route.

Esau said the court heard that on this fateful day the victim boarded the ship at Chirumba in Karonga district under the care of Chemist Masoja, another crew staff.

The police publicist Esau said that on the way, Masoja offered the  girl a bed to sleep in the staff’s cabin and left the situation Pumula took advantage of the co-worker’s absence then defiled the victim.

“During the hearing, Pumula pleaded guilty to the charge which is contrary to Section 138 of the Penal Code. Although the convict asked for lenient sentence saying he looks after his elderly parents, two wives and five children, Magistrate Anthony Banda showed no mercy.

“Banda observed that Pumula failed the responsibility of taking of care the girl who instead turned into a monster and abused her sexually. The Magistrate added that the victim suffered psychological trauma from the experience which would torment her for the rest of her
life”, said Esau.

Pumula hails from Kasankha Village, Traditional Authority (T.A) Namkumba in Mangochi district.
