Malawi’s habitual criminal Molosoni Phiri jailed 21 years for theft

LILONGWE-(MaraviPost)-The Lilongwe Resident Magistrate Court on Thursday,October 22, 2020, convicted and sentenced Molosoni Phiri to 21 years imprisonment with hard labour for robbery and malicious damage offenses.

Molosoni was answering two counts: malicious damage contrally to section 304 of the penal code and robbery contrally to section 301 of the penal code.

Lingadzi Police station publicist Salome Zgambo told The Maravi Post that the court heard through police prosecutor Grace Mafosha that on May 23 2020, Molosoni along with his friends invaded Lilongwe water board in Area 10 and damaged three vehicles as well as stealing properties worth MK4,265,000 million.

Mafosha pleaded with the court for stiffer punishment because Molosoni is the habitual criminal. She said that he was released from jail in February 2020, and that he is currently serving another 12 year jail term sentenced by Mponela Magistrate Court for similar offence in July 2020

“Mafosha further said before committing the present offence, in April alone he also committed two similar offence: one at Airwing and the other one at 6 miles.

“Molosoni was convicted on his own plea of guilty on both counts. In mitigation, Molosoni asked court to give him the punishment in consideration that he is already serving another sentence. He also asked the court to consider untried cases he is answering,” says Zgambo.

Passing judgement, the Residence Magistrate Viva Nyimba believed the evidence by the police prosecutor. He said that mitigation factors are outweighed by aggravated factors in the way that he is repeated offender.

He further said that the accused person has been a habitual criminal since he was 26 years old. Giving him a long term sentence will give a sigh of relief to the public, hence slapped him to 18 years for robbery and 3 years for malicious damage. The offences to run consecutively.

Molosoni Phiri 42 years, hails from Wachaka village in Traditional Authority Wasambo in Karonga.
