LILONGWE-(MaraviPost)-The embattled Malawi Electoral Commission (Mec) Chairperson Jane Ansah is not coming out clearly on whether she will resign after the Supreme Court of Appeal upheld the High Court’s decision to nullify last year’s presidential election.
Ansah had promised to resign if the Supreme Court agreed with the lower court’s verdict.
At the onset of the case, she had also promised that she would throw in the towel if the High Court found the commission in the wrong.
But Sunday, Ansah declined to respond to The Sunday Times question on her next move.
“Kodi kwanuko simupita ku tchalitchi [Don’t you go to church],?” she said before cutting off the line.
Immediately after that, her phone was perpetually engaged.
On her part, chairperson of the Electoral Services Committee of the commission, Jean Mathanga, said Mec is yet to meet to discuss the implementation of the judgment.
“It has just happened last week so we have to meet. We have not received a notice of the meeting but it should be this week I believe,” she said.
Last Friday, a panel of seven judges of the Supreme Court of Appeal upheld the High Court’s judgment that nullified the presidential poll.
The court also upheld an order for Mec to organise another election within 150 days and that the 50%+1 system should be applied in the fresh poll.
MCP and UTM in earlier interviews indicated that they were ready with names of people they can submit to President Peter Mutharika to appoint as new Mec commissioners.
On the other hand, the Judicial Service Commission recommends names of judges from whom a president can appoint a Mec Chairperson.
Registrar of the High Court and Supreme Court of Appeal Agnes Patemba said in an interview yesterday that the courts can only come up with the names if a vacancy is declared.
Despite that, on Wednesday, May 13, 2020, Ansah has the guts to tell the nation of fresh presidential elections’ new dates being June 30, 2020 instead of July 2.
