Malawi High Court rules against Gandhi must fall movement

The High Court in Blantyre has ruled in favor of the #GandhiMustFall Movement on the issue Blantyre City Council (BCC) took to the court to vacate the injunction by the movement against the erection of the ‘Mahatma’ Gandhi statue in Blantyre.

 

Government of Malawi accepted to have the statue erected in Blantyre after the Indian government put it as part of aid package.

This led to the rise of the movement against the statue.

The movement sought an injunction against the statue, which was granted. Through its lawyers, BCC went to the court to have the injunction vacated.

 

But in a ruling made today by Justice Tembo, the council has failed to provide enough reasons for their favored action.

 

BCC sought to vacate the injuction on three grounds – that claimants suppressed material facts, that the balance of justice lies in favor of vacating the injunction and that there is no status quo to be preserved in the circumstances. The council has failed on all the three grounds.
