Opposition DPP’s Mombera University-allocated MK2.4bn plunder on ACB radar

LILONGWE-(MaraviPost)-Malawi’s graft-busting body – the Anti-Corruption Bureau (ACB) – has disclosed that it will institute investigations into alleged plunder of public funds in the construction of Mombera University during the Democratic Progressive Party (DPP) administration.

The DPP government employed hundreds of ghost workers for the nonexistent tertiary education institution, draining billions of taxpayers’ money in the process.

The revelation prompted Human Rights Defenders Coalition (HRDC), in its whistleblower role, to lodge a complaint at the bureau on December 1, 2020.

In the complaint, HRDC alleged that in the 2019-2020 fiscal year, a total of MK2.483 billion was spent on the nonexistent university.

The coalition further alleged that K1 billion was spent on the refurbishment of Mzuzu University library where very little work was done.

After reviewing the complaint, ACB referred the matter to the Auditor General to institute an investigative audit into the matter to inform the bureau’s next course of action.

In a letter addressed to HRDC, the bureau says it has received the investigative audit reports from the Auditor General and has completed an analysis of the findings and recommendations therein.

“Based on the analysis, you are informed that the bureau will not continue to conduct further investigations on the issue of the refurbishment of Mzuzu University library in accordance with Section 10 (2) (b) of the Corrupt Practices Act.

“Further, you are informed that the bureau will proceed with further investigations into the issues surrounding Mombera University,” reads part of the letter ACB Director General Martha Chizuma has addressed to HRDC.

HRDC National Chairperson Gift Trapence expressed delight with the direction ACB has taken to probe the suspected plunder of taxpayers’ money by the former DPP government.

In November 2022, former Director of Public Prosecutions (DPP) Dr. Steven William Kayuni asked the Malawi Police Service (MPS) to launch criminal investigations into alleged fraudulent public funds expenditure on operations of non-existent Mombera University.

In a letter addressed to Inspector General of Police Merlyne Yolamu, which we have seen, Kayuni said the suspected expenses are in billions of kwacha.

In his letter dated November 16, 2022, Kayuni expressed disappointment that the government had been budgeting for the operations of the university which was earmarked to be built in Mzimba.

Kayuni wrote: “The university structure is not on the ground. The university is not in existence. There has never been a selection of students to that university. No employees have ever been recruited for the university.

“That notwithstanding over the years, budgets have been passed not for purposes of implementing the establishment of the university, but for running an existing university.”

He further said documentation shows that there was procurement of services, vehicles, and hiring of staff for the university.

“The government wage bill purportedly showed that payment of salaries to lecturers and staff members included those of famous musicians in the country.

“Expenditure in audit reports points to suppliers of various services such as gardening, landscaping, and cleaning services, purported procurement of vehicles, and services on the said vehicles. The amount runs into billions of kwacha Madam IG,” the letter, number ADMN/MOMB/15/1, further read the letter.

Chizuma faces sacking for lying to Malawians, Chakwera

BLANTYRE-(MaraviPost)-The embattled Anti-Corruption Bureau (ACB) director general, Martha Chizuma, is likely to face the chop anytime soon for disowning a report she presented to President Lazarus Chakwera on the state of corruption in the country.

In June this year ACB presented to the President in which they mentioned names of people who are suspected to have benefitted from a UK-based businessman corruptly.

The effects of that report led to a huge shake up in the government structure.

The President suspended his Chief of Staff, Prince Kapondamgaga, fired the former Inspector General of Police George Kainja and withdrew all delegated powers to Vice President Saulos Chilima.

However, five months down the lane the bureau has failed to act on the findings of its report only to emerge with all sorts of excuses.

Over the weekend Chizuma told Malawi News that she is under siege to deliver and strongly hinted on the bureau’s failure to proceed with what looked like impending big profile cases. 

On Sunday the ACB spokesperson Egrita Ndala, acting on behalf of her boss, told Zodiak Broadcasting Station that the report they presented to the President is incomplete and cannot be used to initiate arrests as Malawians expect.

“We presented the report to the President because he asked for it. We could not go and arrest people because investigations are continuing,” Ndala told ZBS.

Her response on behalf of the bureau vindicates the doubts Malawians have had on Chizuma’s competence. All along she has given a picture as if ACB is ready to pounce on the some or all the 84 people mentioned in the report they presented to the Head of State.   

President Chakwera already questioned the integrity of the report when it arrived on his desk back in June.

On that day he addressed the nation he rebuked ACB for presenting to him what looked like a half-baked report.

“But I must say that while I remain confident that the Bureau is critical to this fight (against corruption), because of the glaring information gaps in its report, including the absence of any information about what the Bureau’s plan of action is, I consider the report to be an example of substandard work. And on a matter as serious and sensitive as this, Malawians deserve better,” said the President.

Now that the bureau has showed its failure to take action, Malawians have now come to see the kind of shoddy work Chizuma and colleagues executed.

They misled the President and the nation on top of victimizing people who are innocent until proven guilty.

There can only be one way for Chizuma and that is ‘out’.

Mwanza man jailed 14 years for defiling 15 yr old girl

On 15th August 2019, the Court found Mr. Katimba guilty and convicted him on both counts. On 23rd August 2019, the Court sentenced him to twelve months and eight months imprisonment with hard labour on each of the two counts respectively. The sentences were suspended to eighteen months and twelve months respectively. The Court considered the fact that he has lost his job and career following the conviction and that he did not personally benefit since the money was recovered in full.

On 13th March 2014 the Anti-Corruption Bureau received a complaint alleging that Mr. Brian Katimba, Acting Registrar of the Industrial Relations Court in Lilongwe was soliciting an advantage from Burundian nationals. Two Burundian nationals sued Jesuit Relief Services at the Industrial relations Court for unfair dismissal. They were award. K300, 000.00 each as compensation by the Court. It was alleged that the Acting Registrar demanded some money from the Burundians for transport.

On 14th March 2014, the Anti-Corruption Bureau arrested Mr. Brian Katimba soon after he had received K100, 000.00 from the Burundians. He was taken to Lilongwe Magistrates Court where he was charged with one count of corrupt practices by public officer and one count of about of office contrary to Section 24 (1) and 25B (1) of the Corrupt Practices Act respectively.

The Anti-Corruption Bureau is warning all public officers to desist from demanding payments for services which are supposed to be offered for free as that is an offence under the Corrupt Practice Act.

Malawi to host first National Anti-Corruption Youth Forum

Anti Corruption Bureau (ACB) has organized National Ant-Corruption Youth Forum to be held on May 30-31, 2018 at Linde Motel in Mponela, aimed to engage the youth in the fight against corruption.

The forum which is first of its kind to be hosted in the country will be carried out under the theme ‘Integrating the Youth in the fight against corruption’.

ACB Director General Senior Public Relations Officer Egrita Ndala said in an interview on Monday saying that the Summit is scheduled to allow youth across the country to share their understanding on corruption cases.

“The main objective of the forum is to provide an environment where the youth can provide their experiences on corruption issues,” she said.

According to Ndala the forum will bring together 50 youth from all the 28 districts of the country.

She said the forum would give the youth a challenge to play their role in the fight against corruption by building up networks with fellow youth in their areas in the fight against corruption.

Titha Youth Movement (TYM) Director, Damson Ntokoma said youth are impressed with the forum saying that it would help to open minds of fellow youth on how to curb the issues corruption which is happening in the country.

“ As a youth organization we are deeply happy for the forum as it will bring a lot of issues on the table regarding to corruption cases, and this will give us a room as youths to know how we can address some issues concerning corruption cases,” he stated.

Ntokoma added that the forum will also give an opportunity to his youth organization to know the status of corruption cases in the country and also to know how to raise awareness to the fellow youth on how to fight against corruption.

The forum has been organized with the funding from the Malawi government.

ACB launches district council integrity program

SALIMA-(MaraviPost)-In an effort to reduce fraud and corruption in the country’s local councils, the Anti-Corruption Bureau has launched an integrity program that aims at empowering council integrity committees in handling corruption issues.

Presiding over the launch on Monday in Salima, Principal Secretary for Ministry of Local Government and Rural Development, Kiswell Dakamau said the program will help to safeguard the council’s finances and other resources.

“The program we have launched today is very critical as you are all aware of the National Decentralization Program. This has increased the amount of resources going to the councils and it is likely it will make the officers more prone to corruption,” said Dakamau.

He added that authorities that have been picked to be in the integrity committees should make sure all the resources that come to sectors of the council are well utilized and used for their intended purpose.

Speaking in an interview, ACB Acting Director General, Reyneck Matemba highlighted that district councils have a crucial role to play in ending corruption and that there was need to provide them with all the necessary support.

“Councils receive a lot of financial support and resources that make them venture into corruption when they don’t have the required integrity in safeguarding the resources.

“So, this will help us to work together in eradicating corruption as well as help the councils to know how they can report corruption cases to the bureau,” he said.

In her remarks, District Commissioner for Ntchisi, Malango Botomani said the training would help the council to be empowered in issues regarding corruption.

BLANTYRE-(MaraviPost)- The Blantyre Chief Resident Magistrate Court on Monday, granted bail to the Judiciary Spokesperson Mlenga Mvula, and Reverend Daniel Mhone, on charges of soliciting bribes with church officials amounting to MK10.7 million

The development quashes ACB’s application to continue keeping the two in custody; the graft fighting body argues that it had not yet recorded a caution statement from the two accused.

The two have been granted bail on the seven conditions including; to present themselves to ACB at 8 am on Tuesday for cautioning, pay MK25,000 bail-bond in cash each, and bring one surety of MK100,000 in non-cash each.

The Court also ordered the two to surrender their travel documents to ACB, and to present themselves to ACB once every fortnight, until the conclusion of the case; lastly they are to to be present during trial and not to interfere with witnesses.

Mvula was arrested by ACB last Friday and spent two nights in custody at Blantyre Police Station, while Mhone was arrested on Monday.

During the bail application, Chief Resident Magistrate Simeon Mdeza, told the Court that the two were brought before Court to be informed on why the State wanted to continue keeping them in custody, and to notify them of the charges laid against them.

Representing ACB, Macmillan Chakhala, told the Court they had not yet taken caution statements from the two accused persons because ACB was busy interviewing witnesses for the case. However, defense lawyer Chancy Gondwe argued that the two, like any suspect, had a right to be released on bail as provided for in section 42 (2) of the Republican Constitution.

“When it comes to issues to do with the release of accused persons on bail, it is a fundamental right. The State has not made sufficient presentation on why the accused persons should not be released on bail,” Gondwe said.

“The fact that the State has failed to record a caution statement from the accused persons, should not be a ground to deny them bail,” he stated, adding that pre-trial detention should not be used as punishment to the accused persons.

Mdeza then adjourned the case to a later date, when the accused persons will be formerly charged and make their pleas. However, he said the Court will await directions from ACB as to when it will be ready.

ACB through a press statement, dated September 1 and signed by its senior public relations officer Egrita Ndala, recorded that in 2016 and 2017, Mvula, on several occasions, demanded money amounting to MK10.7 million from the United Methodist Church through Reverend Daniel Mhone, the Executive Church Member and Conference Superintendent.

ACB arrests Burundian Pascal Rwasa on immigration issues, releases him on bail

The Anti-Corruption Bureau on 9th March, 2017, arrested Mr. Pascal Rwasa (Burundian national) in Balaka for presenting false information that he was related to another foreign national who was applying for Malawi citizenship by presenting the person as his dependent when the person was over 18 years and not related to him.

Rwasa will be charged with uttering a false document contrary to Section 122 as read with Section 360 of the Penal Code.

Rwandan businessman Murekezi sentenced to five-year jail term for duty evasion

BLANTYRE-(MaraviPost)—Rwandan businessman, Vincent Murekezi, was on Monday  sentenced to five years imprisonment for attempting to evade duty of about K2.2 million.

According to press statement by Anti-Corruption Bureau, made available to Maravi Post, Murekezi committed the crime in 2008 in collaboration with Komani Nyasulu, a Malawian national clearing agent.

“In 2008, the Anti-Corruption Bureau received a complaint alleging that on 30th December, 2007, Komani Nyasulu a clearing agent, corruptly received K200, 000.00 from Vincent Murekezi, a Rwandan businessman in order to facilitate evasion of duty of about K2.2 million,” reads the statement in part, signed by ACB spokesperson Egrita Ndala.
