Flywell Banda, a concerned Malawian, has written a letter to Chief Justice Rezine Mzikamanda, calling for urgent reforms in the country’s judiciary. In the letter, Banda proposes key changes, including the incorporation of non-judicial members in the Judicial Service Commission (JSC) to promote greater transparency and accountability within the judicial system.
A copy of the letter, which we have accessed, highlights Banda’s dissatisfaction with the current structure of the JSC, which is chaired by the Chief Justice. Banda expresses concern that only the Chief Justice is empowered by the laws to investigate and resolve complaints against judges. He argues that this process lacks the transparency needed to ensure justice and fairness.
Banda further alleges that since 2022, Chief Justice Mzikamanda has been abusing his authority by failing to address numerous issues raised by Malawians. He accuses the Chief Justice of inaction, particularly regarding accusations of corruption involving certain judicial officers.
In his letter, Banda emphasizes the need for reforms to restore public confidence in the judiciary and ensure that complaints against judicial officers are handled fairly and transparently. His call for reforms comes amid growing concerns about the integrity of Malawi’s judicial system.
