Contested Simplex Chithyola’s Kasungu South Parliamentary seat verdict on Nov 25

LILONGWE-(MaraviPost)-High Court in Lilongwe is set to deliver its ruling on November 25, 2025, in a case between independent candidate Joseph Manguluti and Malawi Congress Party (MCP) legislator Simplex Chithyola Banda, who both contested in the September 16 parliamentary elections for Kasungu South Constituency.

This follows a petition filed by Joseph Manguluti, who is challenging the outcome of the September 16 elections, in which he lost to Chithyola Banda by just over 500 votes

Manguluti alleges that Chithyola Banda’s victory was not a result of genuine popularity or policy appeal but rather influenced by money and manipulation.

On Friday, High Court Judge Redson Kapindu upheld Manguluti’s petition and dismissed an application by Chithyola Banda’s legal team, led by Wapona Kita, which sought to have the case struck out on technical grounds.

In his ruling, Justice Kapindu found that the defence’s arguments for dismissal were insufficient and ruled that the matter proceed to a full hearing.

During the hearing, the lawyer for the petitioner, Chimwemwe Sikwese, argued that there were serious electoral irregularities in Kasungu South constituency and presented his client’s evidence to support the claim.

On the other hand, Kita, representing Chithyola Banda, maintained that the evidence presented was inadequate and asked the court to dismiss the case.

This means Chithyola position as Leader of Opposition in Malawi Parliament hangs inbalance till the verdict is made in the court.

High Court sustains Manguluti case against MEC’s declaration of Chithyola as winner for Kasungu South Constituency

LILONGWE-(MaraviPost)-High Court Judge Redson Kapindu has sustained the case involving Joseph Manguluti against Malawi Electoral Commission (MEC) declaring Simplex Chithyola Banda as a winner for Kasungu South Constituency during the September 16 General Elections.

Judge Kapindu therefore has ordered the continual of the case for further hearing.

Chithyola who won the ticket as Malawi Congress Party (MCP) and MEC are the first and second respondent respectively in the case.

Sikwese is the lawyer representing Manguluti while Wapona Kita leads Chithyola legal team.

This means the case will go into full trial after the court found that reasons for dismissal were not enough.

Chithyola is now opposition leader in Parliament.

LILONGWE-(MaraviPost)-The storm clouds are gathering over Kasungu South as newly elected Member of Parliament (MP) Simplex Chithyola faces an election petition that could spend his short-lived parliamentary triumph.

The High Court is set to deliver its ruling on November 3, in a case that has sent tremors through Malawi’s political corridors—one that strikes at the heart of the country’s long-running battle against electoral corruption and the use of handouts to buy votes.

At the centre of the storm is Bishop Joe Manguluti, an independent candidate who narrowly lost to Chithyola in the September 16 polls by just over 500 votes.

Manguluti alleges that Chithyola’s victory was not born of popularity or ideas, but of money and manipulation, claiming the Malawi Congress Party legislator distributed cash and gifts to sway voters.

In his court petition, Manguluti paints a disturbing picture of an election tainted by handouts and threats.

He alleges that Chithyola handed out K50,000 and K10,000 to traditional leaders, teachers, and youths during the campaign, warning recipients that their votes could be tracked and that they would have to repay the money if they dared vote otherwise.

“Some voters were threatened that they would be known if they voted for someone else,” Manguluti’s petition reads. “It was not an election—it was intimidation disguised as generosity.”


The claims, if proven, strike at the foundation of Malawi’s democracy, raising uncomfortable questions about whether cash and coercion are now replacing conviction and community service as the ticket to Parliament.

According to the official results, Chithyola won 12,349 votes to Manguluti’s 11,817—a gap so narrow that even small irregularities could prove decisive.

But with the court now examining the case, Chithyola’s seat hangs in the balance, and the November 3 ruling could decide whether Kasungu South goes back to the ballot.

For now, Chithyola remains MP, with Malawi Electoral Commission (MEC) lawyer Emmanuel Chapo confirming that no injunction bars him from performing his duties.

But the cloud of uncertainty grows darker by the day.

During the initial hearing, Chithyola’s legal team, led by Wapona Kita, attempted to have the petition thrown out on technical grounds, arguing that Manguluti used the wrong name in the filing—referring to “Simplex Chithyola” instead of his full legal name. The defence also pointed to alleged inconsistencies in sworn statements.

Judge Redson Kapindu, however, adjourned the matter after reprimanding both sides—Manguluti for delaying service of the petition, and Chithyola for failing to file his responses on time. Both have been ordered to pay costs.

The legal wrangling, though procedural, underscores the high stakes and high tension of the case.

For Chithyola, a rising figure in the MCP, the allegations threaten to tarnish not only his personal reputation but also his party’s credibility in upholding clean electoral practices.

Observers say the case reflects a wider crisis in Malawian politics, where handouts and vote-buying have become normalized despite repeated calls for reform.

Civic groups have warned that unless the courts take a firm stand, the practice will entrench a culture of dependency and erode the moral legitimacy of elected leaders.

“This case could become a turning point,” one political analyst noted. “If the court upholds the petition, it will send a strong message that money cannot buy democracy. If it doesn’t, it risks confirming what many Malawians already fear—that elections are for sale to the highest bidder.”

As the date draws closer, tension is mounting in Kasungu South. For Chithyola, the man once celebrated for his grassroots touch, the very acts of generosity that built his brand may now be what unravels it.

Whether the court upholds or nullifies his victory, one thing is certain: the era of handout politics is under scrutiny like never before.

November 3, Malawians will be watching closely—not just to see who wins in Kasungu South, but to see whether the courts will finally draw a bold line between charity and corruption.

CSEIF condemns violence at MCP Kasungu’ Nkhota political rally

BLANTYRE-(MaraviPost)-The Civil Society Elections Integrity Forum (CSEIF) has condemned the violence that erupted in Nkhota, Kasungu on August 17, 2025 during a political rally organized by the Minister of Finance, Simplex Chithyola Banda.

Reports indicate that the rally turned chaotic after a group of individuals, allegedly from the Malawi Congress Party (MCP), pelted stones at attendees, forcing police intervention and the evacuation of dignitaries.

In a statement released on Monday, August 18 CSEIF described the incident as a direct assault on Malawi’s democracy, warning that political violence is increasingly being used to silence dissent and intimidate opponents.

The forum said such conduct undermines genuine competition and deprives citizens of their constitutional right to freely assemble and participate in democratic processes.

CSEIF expressed concern over the lack of intra party democracy, where disagreements are resolved through intimidation and violence rather than dialogue.

The forum called for urgent action, demanding thorough investigations by the Malawi Police Service and the Malawi Electoral Commission to bring perpetrators to justice regardless of political affiliation.

It also urged political parties to instill discipline among their followers, denounce violence as a political strategy, and strengthen internal democratic processes.

The body further appealed for adequate security at all campaign events and encouraged political stakeholders to promote tolerance and respect for dissent as a cornerstone of democracy.

Chairperson Benedicto Kondowe, who signed the statement, stressed that violence has no place in Malawi’s democratic process and reminded stakeholders that elections should be won through ideas and policies, not intimidation or fear.

CSEIF urged all political players to recommit to peace, tolerance, and respect for the rule of law to guarantee credible, free, and fair elections.

Malawi Police accused of favoring Simplex Chithyola Banda’s thugs ahead of polls in Kasungu South

LILONGWE-(MaraviPost)-As the country prepares for the upcoming general elections, the Public Affairs Committee (PAC) has called on the Malawi Police Service (MPS) to clarify their readiness to protect citizens during the campaign period and on polling day.

In response, Inspector General of Police, Merlyne Yolamu, assured PAC and other electoral stakeholders that the Malawi Police Service has intensified security measures to ensure safety for all.

Yolamu emphasized that the police will take swift action against anyone who incites violence or infringes on the rights of others during the campaign, stating that the law will apply equally to all, regardless of political affiliation or region.

However, despite the police’s commitment, residents in Kasungu South have expressed disappointment over the conduct of some officers, particularly from Kasungu Police Station and Chigodi Police Unit, accusing them of turning a blind eye to political violence.

Concerns have been raised following an incident in which known thugs allegedly aligned with incumbent legislator who is also Finance Minister Simplex Chithyola Banda reportedly attacked and severely assaulted Jackson Kansengwa.

Witnesses say the attack occurred without provocation.

Despite the incident being reported to police, and Kansengwa providing all necessary information to aid in the arrest of the suspects, no action has been taken.

Residents claim that the assailants are still roaming freely, and allege that they received funds from the minister to evade justice an accusation that has fueled public outrage and calls for accountability.

Political analysts have since urged the Malawi Police Service to demonstrate impartiality and act on its promises.

They warn that failure to do so may force victims and stakeholders to seek justice through international legal bodies.

The experts further called on the police to operate independently and resist undue influence from politically connected individuals, especially cabinet ministers.

Chithyola Wins by landslide victory in MCP Kasungu South primary elections

LILONGWE-(MaraviPost)-Minister of Finance Simplex Chithyola has emerged a winner in Kasungu south constituency Malawi congress party (MCP) primaries with 2, 216 votes.

Chithyola beat two candidates including Joseph Manguluti who got 112 votes, while Mtunduwatha Chimbalu received 35 votes.

This means The Finance Minister will represent MCP for Parliamentary seat in the constituency candidate during September 16 general elections.

Chithyola win is a clear indication of strong politician who always stands tall against political prosecution.

After declared a winner, Chithyola expressed gratitude to his constituents for trusting him again and promised to continue helping them.

“We have become victorious and I thank the people of Kasungu south for trusting me. I will continue to serve them in the next 5 years, said Chithyola.

A number of Members of Parliament (MPs) accompanied Chithyola during the primaries including Abel Kayembe from Dowa West, Mike Bango from Kasungu North West, Ishmael Onani from Dedza East, Arthur Msungitsa from Dowa Ngala, Francis Belekanyama from Lilongwe Msinja South, and Alfred Jiya from Lilongwe City Centre.

This is the first MCP’ primary elections for a seating MP.

Chithyola won with a landslide victory

LILONGWE (Maravipost): Minister of Finance Simplex Chithyola has emerged a winner in Kasungu south constituency Malawi congress party (MCP) primaries with 2216 votes.

Chithyola was seconded by Joseph Manguluti with 112 votes, while Mtunduwatha Chimbalu received 35 votes.

In an interview with Maravipost, Chithyola expressed gratitude to his community for trusting him again and promised to continue helping them.

“We have become victorious and I thank the people of Kasungu south for trusting me. I will continue to serve them in the next 5 years, said Chithyola.

Alot of members of Parliament accompanied the sitting member to witness the victory.

The famous MPs include Abel Kayembe from Dowa West, Mike Bango from Kasungu North West, Ishmael Onani from Dedza East, Arthur Msungitsa from Dowa Ngala, Francis Belekanyama from Lilongwe Msinja South, and Alfred Jiya from Lilongwe City Centre.

KASUNGU-(MaraviPost)-Reports reaching this publication show that incumbent legislator for Kasungu South who is also Finance Minister Simplex Chithyola Banda is poised to win Malawi Congress Party (MCP) primary elections scheduled on Sunday, April 6, 2025.

This comes barely hours after social media was awashed with reports that Chithyola Banda has withdrawn from contesting for the MCP primaries elections in the constituency.

But sources within the constituency told this publication that Chithyola Banda is the man of the people.

One of the delegates hinted that social media circulations about Chithyola’s withdrawal was meant to confuse MCP supporters behind him ahead of Sunday primaries.

“Chithyola is our man. He has done a lot in the constituency including development projects such road, school blocks, helping the needy with food items.

“We are geared to retain him into the seat. We are not changing at all. Chithyola is our man,” lauds one of delegates who did not want to be named.

The Finance Minister meanwhile disputed reports on social media that he is not running for the MCP) Parliamentary seat.

Chithyola assured The MaraviPost that is prepared to compete against two candidates including Vasco Mtunduwatha Chimbalu and Joseph Manguluti.
