Malawi’s Karonga magistrate court accused of issuing fake warrant of arrest

KARONGA-(MaraviPost)-The Karonga Business Community Chairperson, Wavisanga Silungwe has accused some court officials at the Karonga First Grade Magistrate Court for conniving in issuing an irregular Warrant of Arrest in order to destroy his reputation.

This follows the Karonga Magistrate Court report that shows that Silungwe escaped in hands of court security personnel who detained him for failure to pay MK750, 000 debt.

According to one of the district magistrate court officials who spoke in a condition of anonmity, Silungwe borrowed K750, 000 from Mr Simukonda and agreed to pay him back through the court.

The Court claimed that after seeing that Silungwe breached the agreement, the court started hunting for him but unfortunately he ran in their hands after found him.

While admitting to have K750, 000 debt to Mr Simukonda, Silungwe was quick to say that he is the one who went to Court and proposed the arbitration of the Court because they were misunderstandings.

Silungwe described the warrant of arrest as prematurely fake and irregular and that he never bolted or escaped any arrest and that the Court had not stated payment terms agreement.

“In preamble,the Court failed to follow a right legal procedure of issuing a warrant of arrest. There was no judgment Debt Order or Default Summon. Short-cut issuing an irregular’ mid-night’ warrant of arrest was unfortunate for the Honourable Court, while the issue is still in progress,” said Silungwe.

According to Silungwe, it was him who brought the issue to the court after seeing that Mr Simukonda wanted him to pay unjustifiable K2 million and not K750, 000 he borrowed.

He further said that the matter is at hearing stage where Simukonda was given a chance to bring his witnesses but ironically the file documents were reportedly missing.

Silungwe protested by writting the Court of which he was told to wait the Magistrate direction.

On issue that he escaped in the hands of the court security personnel, Silungwe vehemently denied the allegation saying “I was never approached by any Court Official,nor ‘bolted’ the arrest. These were fabricated staged lies. If it was true, they know my house and my numbers,and am here in Karonga,” he said.

Silungwe then told this publication that his Lawyer,Leonard Mbulo of Mbulo Attorneys will challenge the matter at Karonga Magistrate Court on Monday.

Karonga magistrate court officials denied to issue a comment on the matter.
