Malawi leader promotes judges who handled election case: 11 new High Court judges hired

BLANTYRE-(MaraviPost)—The President of the Republic of Malawi, His Excellency Lazarus Chakwera, in exercise of his powers conferred upon him by section 111 sub section (2) of the Constitution of the Republic of Malawi, has elevated four judges to serve at the Malawi Supreme Court of Appeal.

The judges include Healey Potani and Ivy Kamanga who were part of the panel that handled the historical election which ended in favour of the petitioners Lazarus Chakwera and Saulos Klaus Chilima.

The other two promoted judges are Charles Mkandawire and John Katsala.

The president has also hired eleven new judges.

Agnes Patemba, who was serving as Registrar of the High Court and the Supreme Court of Appeal has been appointed as High Court judge together with His Honour Justus Asante Kishindo, Her Worship Violet Chipao, Her Honour Anneline Kanthambi, Her Honour Vikochi Chima, His Worship Mzonde Mvula and His Worship Simeon Mdeza.

The others are prominent lawyer Masauko Timothy Msungama, William Yakuwawa Msiska, Maureen Kondowe, Mandala Mambulasa, and Charlotte Wezi Malonda.

The appointments are with effect from 20th October 2020, according to a statement signed by Dr. Janet Banda, Deputy Secretary to the Office of President and Cabinet

Chisale claims to have mental issues

LILONGWE-(MaraviPost)-The High Court Judge Justice Ivy Kamanga on Monday, afternoon, September 21, 2020 thrown out an application by former President Peter Mutharika’s personal bodyguard Norman Chisale that he has mental issues hence deserves to be out of the cooler.

This comes after Chisale asked the court to grant him bail citing mental challenges.

However, Judge Ivy Kamanga wondered how a person with mental issues can be signing affidavitis.

Therefore the judge ordered that government certified doctors at Zomba Mental Hospital should examine Chisale not some a medical report from Lilongwe’s Poly Clinic.

Kamanga said the mental report be submitted to court in two weeks.

This means Chisale will remain on remand on murder charges on the death of Issa Njaunju.

Malawi’s Area 18 sewer-water case back to court Nov 21

The High Court in Lilongwe this week adjourned to November 21 2018 mediation talks in the Area 18 water contamination case.

A notice of adjournment for mediation, dated October 18, says Justice Ivy Kamanga will mediate the matter.

This follows the u-turn of Lilongwe City Council (LCC), the first defendant, which decided against continuing with the mediation after it earlier collapsed.

Chance Mwalubunju, Executive Director for Lawyers Forum for Human Rights, who is representing the victims, said LCC stood its ground despite that other institutions, Malawi Housing Corporation (MHC) and Lilongwe Water Board (LWB) opted for a full trial.

“The Council stood its grounds so we could not proceed with the next step but conform to their demands,” he said as Quoted in the Daily Times.

Earlier, the institutions agreed to enter the case into a full trial after other defendants continued to deny liability, despite admitting the incident.

At least 1,300 people want compensation of MK4 million each from the institutions for drinking sewer-contaminated water in July 2017.
