Lazarus Chakwera is failing to unify the divided country as he pursues a blatant agenda of purging Southerners, writes legal expert

President Lazarus Chakwera came to power through an alliance of nine parties called Tonse — meaning “all of us”. The name of the alliance gave an impression of inclusivity but before the ink had dried it became evident that little had substantively changed in Malawi.

The alliance, which had accused former president Peter Mutharika of nepotism and promised to deal with it decisively, immediately committed similar transgressions. Barely two weeks into office, Chakwera announced his cabinet and it was conspicuously dominated by people from his region, with his home district of Lilongwe getting a lion’s share.

The backlash was instant but proved ineffectual as Chakwera defended his picks. Commentators such as Danwood Chirwa, a professor of law at the University of Cape Town, argued that the appointments were a form of political patronage. Those who voted, expecting a radical departure from the ills of the Mutharika administration, were in for a rude awakening. However, few have borne the brunt of the new administration’s duplicity as the southern region’s technocrats.

Though Chakwera had evoked the spirit of inclusivity through the “Tonse” mantra, he has since made it evident that those hailing from the south, which is the opposition Democratic Progressive Party stronghold, has no seat at his administration’s table. Heads have rolled in a purge that has seen Southerners being axed. For instance, Dalitso Kabambe, a reserve bank governor under whose watch Malawi’s currency performed well against major currencies, was sacked. He hails from the south and was replaced by Wilson Banda who comes from the same region as Chakwera.

In three key ministries, a significant degree of institutional memory was obliterated with the firing of three permanent secretaries — Joseph Mwandidya for the ministry of energy, Harry Kanjwe for home affairs, and Wilson Moleni for land affairs — who coincidentally comes from the south.

At the Malawi Revenue Authority (MRA), Chakwera discarded all pretence of impartiality going so far as to overreach and abuse his power as he canned the commissioner-general of the tax body Tom Malata along with his deputy Roza Mbilizi. They both hail from the south.

Without any subtlety, the replacements were from the regions that gave Chakwera votes. Though the mandate to hire or fire for those positions does not rest with the president, Chakwera arbitrarily declared that the appointments he had made for these positions were solely in an acting capacity. For those he has not fired who come from the south, he has redeployed to obscure government offices, which are considered in Malawi as “the Guantánamo bay of the civil service”.

Admittedly, Chakwera reserves the right to bring into service those whom he trusts to execute his agenda, however it is the selective firing that has raised concerns. The fact that most victims of the Chakwera purge come from the southern region has not gone unnoticed. The discriminatory dismissals that Chakwera has pursued since taking up office risk further fragmenting the nation and could threaten peace and stability in the long run.

In the run up to the June 2020 election that ushered Chakwera into power, Malawi’s geographic divisions were exacerbated and exploited by politicians as ethnic tensions heightened. Chakwera was backed by the central region where he comes from and is the traditional base of his Malawi Congress Party (MCP), as well as the northern region where his running mate, Salous Chilima, enjoyed significant support. Mutharika was backed by the southern region. There is undeniably a politics of vengeance at play and it belies Chakwera’s earlier promise to ensure meritocratic appointments in government and state-owned enterprises.

Chakwera now runs the risk of further alienating Southerners given that Malawi’s political leaders are cognisant of the regional fractures and simmering ethnic tensions that became more pronounced during the June 2020.

For instance, Chakwera supporters attacked, maimed and intimidated Democratic Progressive Party (DPP) monitors in parts of the central region. However, Mutharika did not seek any recourse nor did the electoral commission follow up on these incidents. In essence, Mutharika accepted an outcome of an election that was of a lesser quality than the one the courts had nullified.

In his last speech as president, Mutharika called upon his supporters to accept the outcome, ensuring calm prevailed in what was then a volatile atmosphere. Chakwera was a direct beneficiary of Mutharika’s final demonstration of mature and democratic leadership because it allowed for a peaceful and smooth transfer of power.

Despite a peaceful transition facilitated by his predecessor, Chakwera is failing to pursue a path of unifying the nation and bridging the divide, as he pursues a blatant agenda of southern region exclusion. Perhaps the “Tonse” mantra was a mere gimmick, after all?

Not that I wanted to comment on this, but am constantly being asked by friends to say my opinion.

What is bothering me is that even my MCP brothers are tagging me in posts to talk about UTM’s primaries yesterday. Typical of reptiles to call for opinion they can’t stand. Well, for starters, it was very open to see that most of UTM’s updates on their primaries were being disseminated by their opponents.

I fault them (UTM). They should have put in place a very strong network to monitor and manage what was happening and give minute by minute updates. That would have been fair. Instead, what we heard were twisted and bent occurrences that suited the needs of the opponents. They saw an opportunity and utilized the moment.

For some of us, people who are able to read between lines, we read the propaganda and emptied it immediately. Thanks to Zodiak for bringing us closer to what was happening on the ground. Check their page. Now, without emotions, if you look closely at what happened, you will see that UTM has on average scored way better than the other two parties.

What the opponents raised were embryonic concerns that the primaries were hit with low turn out and some irregularities. On the issue of turn out, I think people need to be reminded that what UTM conducted yesterday were primaries, not general elections.

There are delegates responsible to vote and this usually depends on a given constituency. In some places numbers are high while other places have few numbers. It’s expected. For instance, in Mchinji South West during MCP primaries, winner Mr Gumba got 745 votes against the opponent Levie Gwede who got 140. (Malawi24, September 11, 2018).

Now, this is Mchinji where we can’t deny MCP’s superiority and we have a combined votes of 885, does this represent the figures that MCP will get in the constituency during the main elections in May?

So, why then would we say because some winner at UTM primaries got 340 votes, therefore, that person is not popular and will not win in that constituency. People, whatever you are smoking should highly be regulated. Then to the issue of organisation and some fights here and there. What did you expect? Angels to conduct the primaries? That has been an issue in most parties. Happens even with ANC in South Africa.

However, I wish to bring this forth, UTM has dared the rest and to single out MCP, an opponent who has been very vocal of the young party lately, I wish to remind you that while you could not field candidates in the Lhomwe belt, UTM just did. That speaks volumes of how national the party has gone. According to Zodiak, there were a lot of places that conducted primaries and things moved smoothly. The few places had minor problems. It was a big exercise. I have requested information from UTM so I can share. We should all see these statistics.

Now, it takes me to my next thoughts. Like I said before, UTM as a party is not bigger than MCP and DPP and I caution shadow MPs for UTM to tread carefully if they are to make it, meaning, they should work extra hard as individuals to win. A DPP candidate in Thyolo might not really have to struggle to be voted, thus because DPP is bigger and popular in Thyolo. Same with MCP in some parts of the central region. This will not be the case anywhere for UTM. People will have to demonstrate individual strength to win seats.

But again, I said, Chilima as a candidate is more appealing and stronger than Chakwera and APM.

It is not by chance that he fills venues everywhere he goes. It was not by chance that Malawi was at a standstill when he conducted a press conference few months ago. It is not by chance that he came third in that survey by our learned brothers at Chanco despite launching UTM within few months of the survey. Chilima is the guy MCP, DPP members will hate publicly and admire privately. He is the guy that people will be tempted to vote for even when they don’t belong to UTM. It happened with late Bingu Mutharika in 2009. It can happen with Chilima in 2019. An odd numbered year for odd happenings

My prediction remains the same, in 2019 people will vote for a candidate and not really a party. We will be up for great surprises.

Lastly, I just don’t get it. I don’t get it at all. Look at this, MCP says it wants to take out DPP by all means possible, yet when it comes to Chilima, they silently say “bola DPP yomweyo, uyu ayi.” Musamatiseweretse.

MEC: Collection of nomination papers by political parties and independent candidates #MalawiVotes2019

The Malawi Electoral Commission is informing all duly registered political parties and aspiring independent candidates that for the 2019 Tripartite Elections, collection of nomination papers will be done as follows:

  •  All aspiring candidates who will contest on political party tickets will get nomination papers through their party Secretaries General or any officer designated to do so.
  • All independent candidates for Parliamentary and Local Government Elections will collect nomination papers from their respective Constituency Returning Officers (CROs), District Commissioners or Chief Executives from 3rd January to 8th February, 2019.
  • All presidential candidates, party or independent, will collect their nomination papers from the Chief Elections Officer at MEC head office from 3rdJanuary to 8th February, 2019.

All registered political parties are advised to collect nomination papers for distribution to their candidates from the Centre for Multiparty Democracy (CMD) in Lilongwe from 3rd January, 2019.
Requests should be made by party secretaries general or any higher authority designated by the party and should indicate the quantity of nomination papers for each of the two elections thus; Parliamentary and Local Government.

The request can be made by calling the Executive Director of CMD, Mr Kizito Tenthani on 0 999 982 490 or email kizito@sdnp.org.mw, or ktenthani@gmail.com. Requests can also be placed in person at the
CMD offices located in Area 11, Off Chimutu Road, Catholic Secretariat Campus, Lilongwe.

All persons with disabilities need to get a letter from the Federation of Disability Organisations in Malawi (FEDOMA) to qualify for the 50 percent discount on nomination fees. This letter should be attached to the nomination paper during submission. More details can be obtained by contacting the Executive Director of FEDOMA, Mr Action Amosi, on 0998138134 or email aamos@fedomamalawi.org . The letters can also be obtained at the FEDOMA office along Masauko Chipembere Highway in Maselema, Blantyre.

Submission of nomination papers will be from 4th to 8th February 2019. Parliamentary and Local Government candidates will submit their papers to their respective Constituency Returning Officers while presidential candidates will submit their nomination papers to the Malawi Electoral Commission at the Chichiri International Conference Centre (COMESA) Hall.

For the 2019 Tripartite Elections there are 193 constituencies and 462 wards that will be competed for.

Political parties are informed that they will be expected to return to CMD and the Malawi Electoral Commission all unused or cancelled nomination papers.

Malawi President Peter Mutharika says Vice President Saulos Chilima did not help him and the ruling Democratic Progressive Party (DPP) win 2014 elections.

Speaking when he arrived in Mzuzu this evening, Mutharika called out the vice president for being a liar.

During a United Transformation Movement (UTM) rally held at Chule Primary School Ground in Dedza last Saturday, Chilima said DPP should be grateful for the role he played in 2014 elections, saying if it were not for him President Mutharika and the DPP would still be in opposition.

“At every DPP rally they claim that I am an ungrateful person DPP, what should I be thankful for? The DPP would not have won without me. I am not indebted to the DPP. I found you (DPP) in opposition and you would not have won the elections without me,” an agitated Chilima said.

Mutharika hit back at Chilima, saying DPP could have won without the vice president because the party did not do well in all areas tasked to the Vice President.

“His claims that we approached him four times are nothing but lies. He should be shameful. There was a committee that we had set up to select prospective candidates as running mates. We agreed to pick someone from the private sector.

“His name was on the final list of 15 other candidates for the position*. It happened, however, that someone on this committee leaked the list to him. He then came to see me at Area 10 the following morning but I sent him back” said Mutharika.

APM then said Chilima’s contribution was not significant because DPP performed poorly in areas where the vice president was to run campaigns.

Mutharika also said that the period Chilima joined DPP as a running mate was too close to elections to garner enough votes for the DPP to win.

He joined us 60 days before elections and he campaigned in Lilongwe and Mchinji where we performed miserably bad. How then did he help us win?”  wondered Mutharika.

The Malawi ruling Democratic Progressive Party (DPP) never fails to entertain with it’s belief that it is so popular such that it will win the 2019 general elections with a landslide. DPP, a party that rode then ruling United Democratic Front’s (UDF) back into government in 2004, won by 66% in 2009, won by an embarrassing 36% in 2014 and had a meager support of 27% in 2017 (Afrobarometer) should know better that these simple figures can be interpreted by any kindergarten kid as decreasing popularity.

 

A latest poll on the political environment towards the 2019 Tripartite Elections which was conducted by Malawi Institute of Public Opinion Research (IPOR) shows that in August, 2018, 33% of the respondents identified with DPP ahead of MCP(31%) and UTM(17%).

Without necessarily endorsing the results of the poll, it is essential to comment on the published findings, after all they seem to have brought tremendous excitement in the country. The survey for this poll was done in August, 2018, just a month after UTM launch. The fact that such a new organization grabbed a cool 17% just a month after it’s launch should give UTM great encouragement and cause big worries to established parties like MCP and DPP.

According to DPP, this latest poll means they are on the way to a ‘landslide victory’. Unless ‘landslide victory’ has changed meaning, DPP is simply bluffing in public while shitting in their pants with worries in private. In fact this poll will cause earthquakes in DPP. DPP members will now be booking their places with other parties. This is especially so with the politicians who are used to being in government. The current results show that DPP is fast losing popularity and on the way out of government. No sane person would want to be associated with a dying party. It’s just a matter of time before we see mass exodus of members from the ruling party.

Strangely, DPP is claiming the results of a survey done nine months before election and one month after UTM was launched means UTM is not a strong contender and can’t win elections. Pure delusion! Down playing UTM’s strength has now become DPP’s main activity. If you ask DPP whether it is scared of the emergence of UTM under the excellent leadership of Dr. Saulos Chilima, the answer is always no. However, if you follow their actions very well, you will see that they are under tremendous pressure and panic.

Actions speak louder than words. Since the launch of UTM, DPP has tried, without success, all sorts of tricks to counter UTM popularity but has always failed miserably. They have tried buying beer for people to drink near UTM rally venues. They have brought live band entertainment to counter UTM rallies. They have conducted rallies on the same dates and near UTM rally venues and even torching UTM branded cars to disturb UTM rallies but failed.

 

One of the latest embarrassing attempts was what they called ‘the mother of all demonstrations’ to force Chilima to resign as State Vice President. This was not the first time for DPP to organize events aimed at forcing Chilima to resign. On 27th July, 2019, some officials from the ruling Democratic Progress Party (DPP) who are also senior cabinet ministers conducted a press conference to demonize the new broom in town, Vice President of the Republic of Malawi and leader of UTM, Dr. Saulos Klaus Chilima. Among other things, the minister’s main objective for calling the press conference was to force Dr. Chilima to resign as Vice President of Malawi. As expected these calls yielded nothing. It was a pure waste of time.

 

Last week these calls came again. They started with calls by DPP cadets on social media in form of articles and posters. This was followed by an announcement of a ‘mother of all demonstrations’ to force Chilima to resign. On the appointed day, we all waited with anticipation to see the ‘mother of all demonstrations’. When the photo’s of the demonstrations came on social media, I could not help but get embarrassed on behalf of DPP. The people who came to demonstrate could not even fill a small Mazda Bongo Minibus. It was a very sorry sight! Apart from what the statistics are clearly showing, the failed demonstration was clear evidence of loss of popularity by DPP.

 

Make no mistake, DPP and it’s apologists spent a lot of time organizing these demonstrations. Millions of Kwacha’s exchanged hands. The organizers promised DPP gurus that the demonstrations would be massive and would result in Chilima’s resignation. What a waste of taxpayers money!

 

When you analyse the reasons that DPP and it’s paid apologists are advancing for the VP’s resignation, you wonder what these people smoke. One paid cadet said the VP has to resign because it’s his ‘moral obligation’ that any person occupying his office owes the people of Malawi. These are the same cadets that never said anything when their leader, President Mutharika was caught red handed with a dubious 145 million Kwacha in a DPP account that he is a sole signatory.

The latest news is that DPP legal adviser and die hard supporter, who is also the current Malawi Attorney General, Charles Mhango has filed a notice of appeal with Supreme Court of Malawi to challenge registration of UTM as a party. High Court judge John Chirwa last Friday ordered registrar of Political Parties to register UTM within seven days and that the registration should be backdated to September 21 2018. What more evidence does one need to know that DPP is scared to death with UTM?

 

The painted paid cadet who is acting as an Attorney General can not differentiate between a party and government. He is an embarrassment to the law profession. He is using the Attorney General’s Office to fight battles for DPP. The sooner he resigns to concentrate on being a DPP cadet, the better.

 

I keep laughing when I hear DPP talking about a landslide win while at the same time trying all dirty tactics to stop serious contenders like UTM which they tremendous fear because deep down their hearts, they know their popularity is going down everyday. Only blue painted cadets can believe their bluff and delusional claims of a potential landslide win in next year’s elections. The rest of us believe that the battle for control of government next year is not over.

Sometime back, Malawi had a thriving Post Office Savings Bank. Many people used to bank with Post Office mainly because of its availability in most areas including rural. That was the time when many working people had a ‘bank book’. I remembered this because the bank book was a constant source of fights between relatives of a deceased husband and a surviving wife. The relatives would demand this book believing that the deceased husband left some money in a bank account.

In those days and I believe that’s the case until now, many people survived hand to mouth and didn’t keep significant money in accounts. Many people didn’t have any savings. As a result, those that were so determined to get the deceased relative’s bank book would be so disappointed to realize, after getting the book, that their relative died without any money. They would then go on to grab any household items from the surviving wife and kids, piling more misery on a family whose breadwinner was the dead father. That’s how cruel people were before a sensitization campaign against property grabbing minimized such occurrences.

I am narrating this story because I believe President Peter Mutharika, his party the ruling Democratic Progressive Party (DPP), DPP politician-cum-business man Leston Mulli and DPP legal adviser who is also the current Malawi Attorney General, Charles Mhango are now acting like property grabbers who want to rip Malawi off by conniving to bring up billions of Kwachas claims against an already dead Malawi treasury. These people are now employing mafia tactics to steal billions of tax payer’s money. Now that they know their days in government are numbered, they have embarked on a stealing spree that is unprecedented in Malawi.

President Peter Mutharika is the leader of DPP, Leston Mulli is a DPP member and one of the financiers of DPP. Attorney General Charles Mhango is a DPP member and serves as its legal adviser. As DPP members, they have one common goal; to ensure that DPP continues ruling and of course continue getting stinking rich…

To continue ruling, they need to win the next elections. One of the necessary things they need to win an election is have enough money for campaign. If they lose an election, they will also need money, lots of it, because they will no longer have access to treasury. It is only a fool who would think that Leston Mulli, who just a few days ago was dancing lewdly with a young lady at Mlakho wa lomwe ceremony attended by President Mutharika would be claiming billions of  Kwachas from government without the approval of the President.

Just six months ago, Attorney General Charles Mhango authorized payment of K3.1 billion compensation to Leston Mulli-owned firms. Mulli, through Sunrise Pharmaceuticals Limited and Chombe Foods Limited, sued government and claimed K3.1 billion as damages for losses during the July 20 2011 demonstrations in which 21 people were killed. The High court awarded him the money in a default judgement.

Dubiously, the Attorney General authorized the payment when his office was challenging the claims in the Supreme Court of Appeal. The interest of the attorney general should be to vigorously protect government against such hefty claims for payment. There was a chance that the government would have succeeded with the appeal at the Supreme Court. By not protecting the government, Mhango showed that he has no interest of Malawi at heart. Any reasonable person would suggest that President Mutharika, the Attorney General and Mulli benefited from the payment. Otherwise, who in their right mind would just authorize such a huge amount of money without a fight?

The dubious payment was done when government is failing to collect K4.9 billion in loans that Mulli-owned companies obtained from the defunct State-controlled Malawi Savings Bank (MSB). Mulli is the largest beneficiary of the K6 billion toxic loans government took over from MSB, a then wholly State-owned commercial bank, sold in July 2015 to FDH Financial Holdings Limited. Mulli obtained K4.9 billion from the bank while other firms owed over K660 million. It’s reported that three years after government set up the special recovery vehicle to collect the K6 billion, no single tambala has been recovered.

After being paid the 3.1 billion Kwacha, Mulli is now seeking an additional K8 billion, in civil case number 474 of 2012 before the High Court in Blantyre. The 8 billion Kwacha is what Mulli is calling interests on the 3.1 billion Kwacha already paid. The same Attorney General, who dubiously authorized payment of the first claim says will challenge the claim. What a joke!

If you think you have heard enough, hear this; six companies linked to businessperson Leston Mulli have filed a separate K270 billion compensation claim against the government! That amount is about 34% of Malawi’s entire 2014/15 national budget. The companies are seeking K270 billion as compensation for damages for loss of business. They claim that the order by then Minister of Justice and Constitutional Affairs Ralph Kasambara saw government departments stopping to trade with them. They add that the order also froze payments for previous contracts.

Former Minister of Justice and Attorney General in the PP administration, Ralph Kasambara, announced the ban on business dealings with Leston Mulli of MBL Holdings, saying the companies were “the subjects of criminal and tax evasion investigations.” He indicated that at that time overwhelming evidence had been unearthed supporting charges of corruption, money laundering and tax evasion. And who is going to defend government and Malawians in this 270 billion Kwacha case? You guessed right. The same compromised Attorney general, Charles Mhango!

Just in case you have forgotten, in the K2.7 billion Malawi Police Service (MPS) food rations scam, Mhango through his office volunteered to be third defendant in a private company case and went on to execute a consent order committing the Malawi Government to pay part of the sums supplier Pioneer Investments owed privately-owned CDH Investment Bank. This was despite the fact that government had already paid 2.7 billion Kwacha to Pioneer Investments and had no reason whatsoever to join a private case that would make taxpayers lose one billion Kwacha just because of Mhango’s and DPP’s shenanigans.

Part of these funds [about K145 million] from the Pioneer Investment deal ended in a Democratic Progressive Party bank account whose sole signatory is President Peter Mutharika. As another ‘thank you’, Zameer Karim of Pioneer Investments Limited bought five cars worth 85 million Kwacha and registered them in the name of President Peter Mutharika!

These property grabbers are working overtime to milk Malawi to death. They will never cease until Malawians take decisive action against them. Otherwise, Malawi will one day wake up to a bankrupt country. #MalawiVotes2019

Member of Parliament (MP) for Karonga Nyungwe constituency Richard Msowoya who is also the speaker of Parliament has vowed not contest   in the May 21 2019 Tripartite Elections in his area but instead is backing his last born daughter Luwani Msowoya.  #MalawiVotes2019

Msowoya introduced Luwani to the constituents on Sunday when he addressed a rally, saying politics is like a re-lay race and said old people should learnt to leave positions to the energetic youth.

The Speaker is aged 56, but said, in politics people should pass on the mantle while they are energetic and not go over 70 years and still cling to positions.

“When we say old people need to go, I need to walk the talk. I have done my part and I think it is time for young people to take over,” he said.

Luwani, 25, a medical doctor by profession, said she is ready for the challenge.

She said she is going to stand on United Transformation Movement (UTM) ticket a party which her father belongs.

“Yes I will be contesting for a parliamentary seat at Karonga Nyungwe constituency. I am prepared to take on the challenge.

Nyungwe needs more development and I am confident that I can facilitate that”, she said.

“I have passion to serve the people,” said Luwani.

Joyce Banda Elected Peoples party leader says ready to contest 2019 polls

Blantyre (MaraviPost) –  Malawi’s First Female President Joyce Banda  and first  incumbent to lose elections after multiparty system says she is ready to compete for the position once again in 2019 after being nominated as torch bearer  her party People’s Party.

Joyce Banda, who recently returned home after four years of self-imposed exile, was on Thursday elected as her People’s Party’s (PP) to lead it into next year’s national elections.

People’s party delegates from around the country converged in the commercial capital of Blantyre to give Madam Joyce Banda the nod to attempt to wrestle power from President Peter Mutharika’s Democratic Progressive Party (DPP), to whom she lost badly in the 2014 elections.

Banda garnered 1,183 party votes against her little-known opponent Leonard Mphidza who only got 23 votes

In her victory speech, Joyce Banda said she is geared up to lead the party she founded to the polls and will defeat incumbent President Peter Mutharika her nemesis.

“I accept the task you have placed in my hands and I am grateful for the faith you have placed in me,” she told the assembled party delegates.

“I am ready to work hard because the mandate has come from you. I am more rejuvenated because poverty has become worse since the PP left office,” she added.

Former President Joyce Banda laid out her manifesto, promising to restore electricity, education standards, to build a mining industry, to restore the fledging economy, provide affordable housing to the poorest and to provide health care for all.

“It is our right to get proper treatment,” she said.
