A 32 years old man, Atusaye Mwalilino has been sentenced to 12 years imprisonment by the Karonga magistrate court for defiling a 12 year- old girl.The first grade magistrate Chakaka Nyirenda, sentenced Mwalilino on Friday after pleaded guilty to the defilement charges under section 138 (1) of the country’s penal code.
Police prosecutor, Sub Inspector Kelvin Kamanga told the court that Mwalilino made the offense on 15 July, 2016 at Luhimbo village in the district.
It is reported that the offender took an advantage of the absence of the girls’ parents during the fateful day.
Medical report from Karonga district hospital confirmed that the girl was defiled.
Before the judgment, Kamanga asked the court to give tough sentence saying “defilement is a serious offense.”
“Your worship, cases of defilement are very common and increase in Karonga district. It is therefore my plea to this court to impose a stiffer sentence to the accused person,” said Kamanga.
In his mitigation, Mwalilino pleaded forgiveness while putting blame on the devil for his conduct.
However, magistrate Nyirenda ordered Mwalilino to serve 12 years imprisonment with effect of the date of the arrest.
Mwalilino hails from Mwmbuli village in the area of Traditional Authority Kyungu in Karonga district.
