High Court in Lilongwe has reinstated bail for lawyer and former justice and Constitutional Affairs Minister Raphael Kasambara and former Malawi Defence Force (MDF) soldier Macdonald Kumwembe.
Kasambara and Kumwembe’s bails were revoked by High Court Judge Michael Mtambo on September 23, 2015 over what he claimed was an infringement on his private space by allegedly accessing his private information; making them to spend five and four months respectively on remand at Maula prison.
The two including businessperson Pika Manondo are defending themselves in the shooting case of former budget director Paul Mphwiyo at the gate of his Area 43 residence in Lilongwe on September 13 2013.
During the ruling on Wednesday, the Judge said the two deserved bail because the State prosecutors had then finished parading their witnesses and that they can no longer threaten witnesses.
They have however been warned against talking about the case to the media or publicly.
Raphael Kasambara has decided to be his own lawyer and since then he has been bested by the Prosecution team. Mary Kachale has won decision after decision at the expense of the famed lawyer.
