BLANTYRE-(MaraviPost)-The Chikwawa Second Grade Magistrate Court on 22 December 2020 convicted and sentenced 43 years old Kamfosi Nkhanyira to seven years Imprisonment for attempting to sell his 14 year old biological son.
Court heard through prosecutor Sergeant Emmanuel Namarwa that on December 22, 2020 at around 19 hours, Nchalo police were tipped off that Nkhanyira was selling his biological son at Miseu Folo Trading centre.
Instantly, criminal investigation department (CID) personnel rushed to scene where one officer posed as a potential buyer and agreed to meet at Goma primary school.
Upon arrival at the said place, the convict came with his son and demanded MK4 million.
Subsequently, he was immediately arrested before the sale.
In court, Nkhanyira pleaded guilty for the charge of selling a child which contravenes section 82 (a)as read with section 83 of the child protection care and Justice Act.
In his elaboration Dickson Matemba spokesperson for Chikwawa police station said, in submission, Sergeant Emmanuel Namarwa asked court to give stiffer custodial sentence considering that Nkhanyira as a father needed to be a protector to the son not be a monster.
Namarwa further said that such a stiffer custodial sentence will deter other would be offenders.
In mitigation, Nkhanyira asked court for leniency, saying that he looks after his family which depends on him as breadwinner and that he is the first offender.
Passing sentence, second Grade Magistrate Joram Zebron concured with the state and sentenced Nkhanyira to 7 years Imprisonment with hard labor.
Kamfosi Nkhanyira hails from Jauma village traditional authority Ngabu in Chikwawa District.
