MCP falls as Mzuzu court dismisses Mzomera Ngwira case

NO CASE TO ANSWER

MZUZU-(MaraviPost)-The main shareholder in Tonse government Malawi Congress Party (MCP) on Monday, May 31, 2021 was to put to shame by Mzuzu Senior Resident Magistrate Court which ruled that Christopher Mzomera Ngwira has no case to answer.

Mzomera, a former Democratic Progressive Party (DPP) regional governor for north, alongside others were answering charges of inciting violence.

In his ruling on Monday morning , Senior Resident Magistrate Peter Kandulu said the state failed to prove the matter.

It was alleged that Mzomera and the co-accused Persons namely DPP’s deputy director of operations Joe Nyirongo, George Mwamtobe, Lumbani Munthali and Thembisile Nkos disrupted a political rally at Chibavi in Mzuzu City on March 20 2016.

The rally was addressed by President Lazarus Chakwera representing MCP, Alliance for Democracy (AFORD) leader Enoch Chihana, and  then People’s Party (PP) third vice-president Kamlepo Kalua.

Currently, Mzomera Ngwira is serving four jail term at Mzimba prison for public theft.

MZUZU-(MaraviPost)-The ousted Democratic Progressive Party (DPP) regional governor for the north Christopher Mzomera Ngwira on Saturday, June 27, 2020 disclosed that party gurus are hiding following the June 23 fresh polls.

Ngwira was addressing the news conference in Mzuzu.

Mzomera claims that is receiving threats from Tonse Alliance followers that together with his boys will be dealt with after the official announcement of the elections.

He however told reporters that on Thursday 25 June,2020, MCP/UTM supporters were seen harassing DPP supporters at Mzuzu shoprite round about on the presence of policemen who were just watching.

“My car was stoned at roundabout and as l drove towards my house in Lubinga l found other supporters waiting for me at a junction saying bad words to me and threatened to deal with me after the official announcement of the results,” said Mzomera.

He added, “I’m worried because most of my boys stays in locations where there is no security and their lives are in danger”

Malawians are waiting for Malawi Electoral Commission (MEC)’s official results of the fresh presidential poll held on Tuesday, June 23, 2020 where unofficial results indicates that Lazurus Chakwera the torch bearer of Tonse alliance is leading with 61%.

DPP/UDF alliance runningmate Atupere Muluzi who is also the son to the former president of Malawi Bakili Muluzi on Friday, June 26, 2020 reacted to the speculations of their loss by asking their supporters to remain calm as they are waiting for the official results.

Meanwhile a leaked video is showing Dr Lzarus Chakwera leaving his Namiwawa resident in Blantyre on a convoy with government armed security officers to Lilongwe.

High Court throws out Former Malawi leader JB claim on Mzomera vehicle

The High Court in Mzuzu has dismissed a claim by former president and People’s Party (PP) leader Joyce Banda to reclaim a vehicle from former PP provincial chair (North), the Reverend Christopher Mzomera Ngwira.
Banda took Ngwira to court to reclaim the vehicle after Ngwira was kicked out of PP and joined the governing Democratic Progressive Party (DPP), but Ngwira insisted that Banda gave him the vehicle as a gift.
The High Court had earlier ordered the two parties to go for mediation to resolve the matter.
But Banda is reported to have been shunning mediation, having failed to show up on two occasions despite the court asking for her presence.
It is her failure to comply with a court order that has forced Judge Thomson Ligowe to dismiss Banda’s application.
According to a ruling seen by The Nation, Banda failed to show up for the second time despite the court issuing a punishment for a fine in the first boycott.
After the second boycott, the judge observed that the fine will not help matters and went ahead to dismiss the case.
“In this case, for two times the claimant has failed to attend the mediation session without a good cause. Last time, I ordered penalties to be paid but it didn’t work. I have no option today but to dismiss her claim. It is so ordered,” reads the ruling by Ligowe.
The judge also urged Banda not to bring the case before him again, but said she is free to restore the matter before another judge and will have to show good cause for having failed to attend the mediation before Ligowe.
Speaking in an interview yesterday, Ngwira maintained that the vehicle in question was a gift and Banda’s failure to participate in the mediation indicates that she was not interested in the matter.
He claimed some people are behind the case and are using Banda as a shield to get the vehicle.
Ngwira said he does not have any grudge against Banda and he sees no reason why she could take him to court after presenting the car as a gift to him.
He said: “I can assure you that it is some people within the party who are not happy that Banda gave me the car. The people ganged up against me and kicked me out of the party and they started claiming that I owe the party items.
“I don’t have any grudge against her and everyone knows I was kicked out of the party by people with ill intentions and they are the same that wanted the car. If she was behind the case, she was definitely going to come for mediation.”
When called for comment, Banda’s lawyer George Kadzipatike said the claim is still valid but could not take more questions as he was driving.
In January this year, the High Court in Lilongwe declared Mzomera Ngwira bankrupt for failing to repay a K62 million debt to Tata Zambia.
Lawyers for Tata Zambia told the court that Mzomera Ngwira had in 2016 bought vehicles worth MK52 million whose repairs and spares had cost MK7 million and MK3.2 million, respectively.
The judge heard that Ngwira was supposed to pay the money once but had not done so, even after the payment mode had been changed to monthly instalments; hence, declaring him bankrupt.
The Mzimba-Hora legislator is now a member of the governing DPP. According to the law, an elected public officer should be removed from office if declared bankrupt.

Fired Peoples Party (PP) Member of Parliament (MP) for Mzimba Hora Mzomera Ngwira on Wednesday was suspected to be drunk as he disrupted the house business by bringing contrary issues.

The house was debating issues concerning the bill of national park and wildlife as presented by the Minister of Natural Resources Bright Msaka.

However, when he rose to contribute, Ngwira started accusing people from the southern region of  being the controllers of any kind of leadership instead of commenting on the matter which was being discussed.

“Why should every position be controlled by the southerners? Should we say that they are the only ones to lead this country?” wondered Ngwira.

Despite the deputy speaker of Parliament Mcheka Chilenje saying he was out of order, Ngwira who seemed to be in angry mood with the development continued his controversial remarks without fear.

“This house should approve the bill that will share the leadership such as the governor of the Reserve Bank, President and others. For example, each and every region should have its term not just the south,” said Ngwira.

However, drama erupted when the speaker switched off the microphone used by Ngwira and the MP jumped to the nearby microphone and the speaker switched it again.

The other MPs in the house especially from government side suspected that Ngwira was drunk while shouting at him to seat down.

The deputy speaker then threatened to throw Ngwira out of the house using the standing orders if he continues disturbing the house business.

The MP who was uncontrollable during the day, came out of the Parliament on his own and then the house continued its business.
