LILONGWE-(MaraviPost)-Malawi President Lazarus Chakwera is illegally advised from his Malawi Congress Party (MCP) misguided cadres on state matters while constituted Office of Attorney General (AG) remains intact to serve the nation better.

AG Chikosa Silungwe has been advising legally Chakwera’s Tonse government on state matter but the President is doing contrary.

On Tuesday, Secretary to The President wrote Malawi Electoral Commission (MEC) commissioners Jean Mathanga and Linda Kunje that have been fired without seeking advise from AG office.

Now, AG Silungwe has written Tonse government that the sacking of the two means that MEC is incapacitated, does not exist.

In a press statement made available to The Maravi Post dated April 13, 2021 Silungwe says: “I have taken note of the purported rescission of the appointment of Commissioner Linda KUNJE and Commissioner Jean MATHANGA respectively.

“One of the effects of the rescission of the appointment of the two Commissioners is that there is no Electoral Commission in accordance with section 75(1) of the Constitution. My advice is that the remaining members of your cohort should not discharge any duty or power of the Electoral Commission under the Constitution or an Act of Parliament until section 75(1) of the Constitution has been complied with”.

President Chakwera reversed a decision of his predecessor, Peter Mutharika, appointing Angelina Linda Kunje and Jean Mathanga as commissioners at the MEC on June 7, 2020.

Secretary to the President and Cabinet Zanga-zanga Chikhosi, also commented that the reversal of the decisions is premised on the fact that the two were adjudged incompetent by the Supreme Court of Appeal on 8th May, 2020

“… by appointment of the law and pursuant to Section 75 (3) (b) of the Constitution, your appointment was rendered defective as you were disqualified for appointment as an Electoral Commissioner in light of the Supreme Court determination I,” says Zanga zanga in his letter to Kunje.
