Publicity Secretary for the former ruling Democratic Progressive Party (DPP), Brown James Mpinganjira has claimed that Tonse Alliance government is not respecting the principles of separation of powers amongst three arms of the government (Parliament, Executive and Judiciary).

Mpinganjira, widely known as BJ, said this after members of the Public Appointments Committee (PAC) of Parliament rescinded its earlier decision to confirm Martha Chizuma as Director of the Anti-Corruption Bureau (ACB).

Last week, the Committee rejected her appointment saying she failed to reach the required score during the confirmation process.

But this did not go down well with some quarters of society who exerted pressure on PAC to reconsider her appointment.

PAC therefore, met on Monday at the Parliament Building in Lilongwe where they confirmed her as Director of ACB.

However, Mpinganjira, writing on his official Facebook page, asserted that MCP is very undemocratic as it ignores decisions made by Parliamentary Committees.

“Adani Osekerera has helped to wrongly impose the rejected Candidate who failed the interview. It is a fact that she is an illegal and will remain an Illegal Head of ACB.

“The Regime is not respecting the Principles of Separation of Powers amongst the three Arms of Government. Illegal Head!” posted Mpinganjira.

Meanwhile, Human Rights Defenders Coalition (HRDC) has cancelled demonstrations it planned against PAC’s decision.

PAC Chairperson, Joyce Chitsulo justified the latest decision and that procedures were followed.

Chitsulo, who is a Member of Parliament (MP) for Mwanza West, stated the House adopted a motion from Dowa North East MP Sam Kawale that moved the Committee to reverse its earlier decision.

Out of 13 members present, 12 voted in favour of Chizuma’s confirmation, one abstained and four DPP members walked out.

“We followed all the procedures, one member exercised his right by abstaining while four DPP members walked out, so those that were available supported her appointment,” said Chitsulo.
