KARONGA (Maravi Post)—The Karonga first Magistrate court has on Thursday sentenced a 49 years old man to 10 years Imprisonment with Hard Labor (IHL) for defiling a 15 year old girl.
The court heard that Faison Minga defiled a girl on evening of 20 December 2016, at his garden location while his wife was away at home.
Minga took advantage of the absence of people around his garden which was far from the residential area to defile the girl which is contrary to section 138 of the Country’s Penal Code.
It was also revealed that Minga wrapped the victim’s mouth with his shirt to prevent her from shouting before undressing.
In mitigation, Minga asked for leniency but State Prosecutor Tamala Banda pleaded with the court for a stiffer penalty arguing that the offence was a felony which attracts a maximum penalty of death or life imprisonment with hard labor.
She further argued that as a father, Minga had a duty to protect the child, and as a parent he was supposed to be exemplary.
Passing the judgment, first magistrate Chakaka Nyirenda concurred with the Prosecutor saying it is the duty of the court to protect children from people like Minga by imposing stiffer sentences to deter others from committing such offence.
He then sentenced him to 10 years Imprisonment with Hard Labor (IHL).
Minga hails from the area of group village headman Mwandambo in Traditional Authority Mwakawoko in the same district.
According to the police report, the cases of defilement are now rampant in the district than any other cases.
