Judgement Day: Malawi ConCourt faults MEC for despising BDO report

LILONGWE-(MaraviPost)-The ongoing Malawi Presidential Election Case ruling under way, the Constitutional Court (ConCourt) has faulted Malawi Electoral Commission (MEC) for ignoring errors in Binder Djiker Otte (BDO) report in determining the winner.

The court finds that MEC failed to detect errors to take action on altered results and use of tippex. Mr. Alufandika did that after results were already announced.


The court says a BDO Report indicates that auditors were given a letter authorising them to approve altered result tally sheets.


The court finds this to be a serious misconduct in management of an election.

Mec asked BDO to change their findings,which BDO refused.
Mec announced results without full calculation of all votes.

Determination of complaints was done after announcement of the winner, this is against section 97 of PPEA.

Despite receiving the complaints Alufandika and MEC went on to announce the results.

A lot of tally sheets that were used to determine the winners were marred in tippex in high volumes. 

Which is totally against the standards of running a fair,credible and just election according to Presidential and Parliamentary Act (PPA).


Alfandika agreed too,they never fulfilled the duty of resolving the problem at hand before announcing.

The court is yet to make the final ruling by close of business of February 3, 2020.
