Justice Charles Mkandawire, a Lilongwe High Court Judge on Tuesday, recused himself from Rwandan fugitive Vincent Murekezi’s extradition.
State Prosecutor Steven Kayuni, said Mkandawire informed both parties about his decision.
According to Kayuni, the Judge Mkandawire argued that he is working on a similar case, hence the decision.
The case will therefore adjourn, until the judiciary assigns it another judge.
Murekezi was reported to be among Rwandans that took part in the 2004 genocide, and seeking refuge in Malawi.
The reports, attracted calls to have him extradited to his country to serve his jail term.
However, the calls hit the wall, since Malawi and Rwanda at that time, had no agreement to extradite convicts and criminal suspects.
The calls were later resuscitated, after the two countries signed the extradition treaty.
Murekezi’s lawyer however, is challenging the treaty, and argues that the treaty was executed without following appropriate procedures.
