THOUGH CONSTITUTION OF MALAWI IS SILENT ON INTERIM GOVERNMENT,
Progressive and active nations could have forced Peter Mutharika not to participate in the revised elections coming on July 4, 2020.
Peter Mutharika is guilty of rigging elections with Malawi Electoral Commission, the fate which will befall MEC is the same fate that must befall Peter Mutharika.
By being involved in the electoral fraud Peter Mutharika automatically relinquishes power in the president office.
When head of state is involved in bribing courts, he is guilty and in contempt, which clearly and technically render his office vacant.
During “Tempe sede vacante” in Roman law of the Vatican, Camalengo is defacto ruler of the Vatican in the absence of the Pope.
In case of Malawi all powers lie on the “Flag of Malawi” now, but the Flag cannot stand without a holder.
The Spear of Truth (Muvi Wa Chilungamo) therefore appointed Chief Judge Andrew Nyirenda, Malawi Defence Force General Nundwe and Speaker of Parliament Catherine Gotani Hara as officials holding temporarily the office of the president in Malawi from the 3rd February to 4th July 2020.
Mr. Peter Mutharika was supposed to vacate state house to give space the three run an interim government.
Strategic appointments like that of new MEC, use of budget, security and finance must be in the hands of Parliament not the “power stripped” Peter Mutharika.
Though the law is silent on interim government it is loud on who the president should be.
Peter Mutharika acted unconstitutionally by conniving with MEC to rig elections in his favour, he is also found guilty of bribing judges using his tribesman Thom Mpinganjira, the constitution is clear to fire Peter Mutharika.
Any person found with these cases is and must automatically be removed from presidential office and be barred from taking any oath of office.
Numb and docile with stupidity the society of Malawi is, we are leaving a person that has committed serious state offences remain in power.
Muvi Wa Chilungamo and Centre For the Future deny being docile, numb or stupid letting a criminal at the helm of supreme rule of our country.
We may not have power to remove Peter Mutharika, but we will not keep quiet and watch Peter Mutharika destroy the welfare of our constitution.
Silence in the times where need is certain for society to voice out is evil and backward thinking.
The Utopian Philosophy will fight till justice blankets Malawi.
On the 3rd February 2020 constitutional judges freed Malawi, this is the day Peter Mutharika resigned or was relieved of his duties as president of Malawi.
Until the 4th July 2020 Peter Mutharika remains a “shadow” but not a president of Malawi.
