
MZUZU-(MaraviPost)-The Mzuzu High Court has thrown to the bin an application by Ralph Mhone not to pay MK40 million as costs for his loss in the Nkhata Bay Central Constituency parliamentary elections results case.
Mhone who challenged the results of the May 21polls in the said constituency took the matter to court against Simon Vuwa Kaunda.
However, Mzuzu High Court, through Judge Thomson Ligowe, ruled that Mhone did not provide substantial evidence to support his allegations that Kaunda rigged the elections.
Confirming the development, Leonard Mbulo, lawyer representing Simon Vuwa Kaunda, said:
“We went before the judge today, this morning, on an application which was made by the petitioner who is now appealing to the Supreme Court; where they were seeking an order to suspend the judgment of the High Court, pending the hearing of the Appeal.
“We presented our side and the judge has dismissed that application; basically, allowing the judgment to still be effected.”
Lawyer for Ralph Mhone, Wesley Mwafulirwa, could not be drawn to comment on the matter.
Mhone appealed to the Supreme Court of Appeal challenging the judgment which was passed on 16th September, 2019, in favour of Simon Vuwa Kaunda.
He argued that the High Court Judge did not take note of some principles of the law in his judgment.
